چالش های ناشی ازعدم تحدید‌حدود فضای ماوراء جو بر امنیت ملی و حاکمیت دولتها

با پرتاب اولین قمر مصنوعی به فضا و استقرار نخستین ماهواره در مدار زمین، مساله محدوده و گستره حاکمیت کشورها در حریم هوایی و فضای ماوراء جو به یکی از چالش‌های مهم حقوقی تبدیل شد. با شروع عصر فضا مجادله و چالش بر سر تعیین مرز میان حریم هوایی که حاکمیت مطلق دولتها در آن جاری است، و قلمرو فضایی که ادعای حق حاکمیت برآن ممنوع گردیده آغاز شد. این پژوهش به دنبال پاسخ به این پرسش است که چه نظرات و رویه‌هایی درخصوص قلمرو فضای ماوراء جو وجود دارد؟ عدم تحدید حدود فضا چه چالش‌هایی بر امنیت ملی و حاکمیت دولتها ایجاد می‌کند؟ نتایج تحقیق که با روش تحلیلی توصیفی انجام شده نشان می‌دهد عدم تعیین مرز میان هوا و فضای ماوراء چالش‌های متعددی همچون ایجاد ابهام در تعیین مسئولیت دولتها در حریم هوایی و قلمرو فضایی، محرومیت کشورهای درحال توسعه را از حق دسترسی آزاد به فضا، مجادله برسر حق عبور بی ضرر در قلمرو هوایی، بحث حق دفاع از خود در مقابل پایش زمینی و سنجشی ماهواره‌های نظامی و استقرار تسلیحات فضاپایه در ارتفاعات زیرمداری را مطرح سازد. محقق در این پژوهش با احصاء این چالش‌ها، رهیافت‌های مناسبی را برای ارتقا امنیت ملی پیشنهاد نموده است.

The challenges posed by the non-delimitation of outer-space on national security and states sovereignty

With the launch of the first artificial satellite into outer space and the deployment of the first satellite in Earth’ orbit, the issue of the extent of sovereignty in the atmosphere and outer space has become one of the major legal challenges. Since the beginning of the space age, legal disputes begin over the delimitation of the airspace over which the absolute sovereignty of states is established, and Outer space domain, in which has not subject to national appropriation or claim of sovereignty accepted. This research seeks to answer the question of which Theories and thoughts exist on the realm of outer space, and what are its challenges to national security and state sovereignty? The results of this descriptiveanalytical research show that the lack of delineation of the boundary between airspace and outer space poses numerous challenges such as: uncertainty in the states’ responsibility in airspace and outer space, deprivation of developing countries to outer space free access, ambiguity in selfdefense against the deployment of military and ground monitoring satellites, and deployment of weapons in outer space suborbital altitudes. To address these challenges, the researcher has suggested appropriate approaches.
