بررسی نظارت فقها بر جمهوری اسلامی با بررسی موضوعی نظارت بر ولی فقیه

دین اسلام، نسبت به نظارت بر حاکم و زمامدار حکومت اسلامی تاکید دارد. مبانی اسلام نیز قدرت، بدون نظارت را موجب فساد دانسته و بر ضرورت نظارت تاکید دارد. نظارت بر ولی فقیه در زمینه‌ شرایط و عملکردی است که لازمه آن، دانستن ویژگی‌های ولی فقیه و همچنین وظایف او از منظر فقه و قانون اساسی است که با توجه به اهمیت آن و نقش مهمی که فقها در این زمینه دارند، تاکنون بررسی جامعی از منظر فقه و قانون اساسی انجام نشده است. در اسلام ادلّه­ای وجود دارد که نظارت بر ولی فقیه را اثبات می‌کند که عبارتند از: عدم عصمت، نصیحت حاکم، امانت بودن مسئولیت و جمهوریت حکومت. نظارت بر ولی فقیه شامل نظارت درونی و بیرونی است و مراجع ناظر بر وی نظارت الهی، همگانی و نهادینه را شامل می­شود. برخی از اصول قانون اساسی جمهوری اسلامی ایران، بر اهمیت نقش مجلس خبرگان رهبری که نهاد فقاهتی در جمهوری اسلامی است و وظیفة قانونی این نظارت را به عهده دارد، اشاره می‌کند. در این پژوهش با روش توصیفیتحلیلی سعی شده تا نظارت و نحوه آن از منظر قانون اساسی و فقه مورد بررسی قرار گیرد و این رهیافت، دیدگاه‌های دیگر اندیشمندان اسلامی را مورد نقد و بررسی قرار داده است.
