فرایند تاریخی قرارداد 1975 الجزایر – اروندرود(1975 – 1981)

بنیان پژوهش حاضر مبتنی بر پایبندی به عهدنامه ی 1975 که از جامعیت و یکپارچگی لازم برخوردار است و برای حل اختلاف بین ایران و عراق دارای اهمیت حیاتی می باشد. روش این پژوهش تاریخی - کتابخانه ای است و در این مسیر مشخص گردید که اختلافات بین دو کشور دارای تاریخی طولانی است. پس از استقلال عراق، منازعات مرزی با ایران افزایش یافت و دو کشور به طور دائم در تلاش برای حل این منازعات با سازوکارهای حقوقی بوده اند که از مهمترین این اقدامات، انعقاد قرارداد 1975 الجزایر می باشد. عهدنامه ی الجزایر با در نظر گرفتن نحوه ی تدوین محتوایی و جزئیات حقوقی آن از جامعیت لازم برخوردار است. این قرارداد کامل ترین عهدنامه برای مدیریت دراز مدت اختلافات ژئوپلتیکی بین ایران و عراق است و اروند رود به طور طبیعی یک خط مرزی را تشکیل می دهد. اگر چه بعضی از دولتمردان فعلی عراق دیدگاه های جدید و گاهی مغرضانه در مورد این قرار داد دارند، به هر حال اجرایی کردن کامل عهدنامه و پایبندی دو کشور به آن پروتکل الحاقی تامین کننده ی منافع جمهوری اسلامی ایران است و دیدگاه های جدید از طرف مقابل به عنوان تهدید تمامیت ارضی ایران می باشد.

The Historical Process of the 1975 Algeria's Convention – Arvandrood(1975 – 1081)

The basis of this research is on the adherence to the 1975 convention that is comprehensive and integrated and is considered crucial and necessary to resolve a dispute between Iran and Iraq. The study was conducted in historical - library research method and in this way it was found that the disputes between the two countries have a long history. After the independence of Iraq, border disputes with Iran and the two countries increased constantly they were after legal mechanisms to solve the conflict among them was 1975 Algeria's Convention the most important. The Treaty of Algeria, considering how to develop legal content and details, has the necessary comprehensiveness. The convention would be a perfect contract for the management of long-term geopolitical conflict between Iran and Iraq and Arvand Rud normally forms a boundary line. Although some of the current Iraqi government bodies have sometimes biased views about the contract, however, the full implementation of the Convention and the two countries' adherence to the Additional Protocol would guarantee the provision of interests of the Islamic Republic of Iran and the new perspectives on the opposite side are considered as a threat to Iran's territorial integrity.
