بررسی وضعیت حقوقی استرداد مجرمین در قلمروحقوق کیفری بین المللی

امروزه کنترل جرایم علاوه بر تلاش کشورها در سطح داخلی به ویژه با توجه به گسترش جرایم سازمان یافته و فراملی، مستلزم همکاری منطقه ای بین کشورهای مختلف و در مواردی همکاری همه کشورهای جهان می باشد.همکاری کشورها در خصوص مبارزه و کنترل جرایم به خصوص جرایم بین المللی فرامرزی در قلمرو حقوق کیفری بین المللی مطرح می باشد. در حقوق کیفر بین المللی این همکاری می تواند در دو عرصه مهم شامل معاضدت قضایی و استرداد مجرمین واقع شود. هدف از انجام این تحقیق، تعیین وضعیت کنونی قرارداد استرداد مجرمین در قلمرو حقوق کیفری بین المللی با نگاهی به قرارداد استرداد مجرمین بین دولت جمهوری اسلامی ایران و سایر کشورها می باشد. به این منظور با مراجعه به منابع علمی مدون شامل کتاب و مقالات علمی، پایان نامه ها و رساله های دانشجویی و همچنین پژوهش های علمی صورت گرفته، اطلاعات مرتبط با موضوع تحقیق به روش اسنادی استخراج و جمع آوری شده و سپس به روش تحلیلی و توصیفی مورد تجزیه و تحلیل قرار گرفته اند. نتایج حاصل از این بررسی نشان می دهد که با وجود ضرورت انعقاد معاهده بین المللی و تفاهم جهانی بین کشورهای جهان در خصوص استرداد مجرمین، با این وجود به دلایل مختلف عمدتاً سیاسی تاکنون چنین موافقتنامه ای در سطح جهانی منعقد نگردیده و موافقتنامه های استرداد مجرمین محدود به موافقتنامه های منطقه ای می باشد.

The Investigation of the Extradition of Criminals' Legal Situation in the Realm of International Criminal Law

Today, crime control requires efforts of countries in the local level, especially with regard to the spread of organized crime and trans-regional, as well as regional cooperation between different countries and in some cases the cooperation of all countries of the world. The cooperation of our country in the fight and control against international crime, particularly cross-border crimes, is in the realm of international criminal law. In international criminal law, this cooperation can be in two important areas of judicial assistance and extradition of criminals. The aim of this study was to determine the current status of the extradition treaty in the field of international criminal law with a view to extradition of criminals agreement between the Islamic Republic of Iran and other countries. For this purpose, referring to written literature, including books and scientific papers, theses and dissertations for students as well as the scientific research, the required data were extracted and using documentary study and then have been analyzed via analytical and descriptive method. The results of this study show that despite the need for an international treaty on extradition of criminals and international cooperation between countries, for different reasons, mainly political such an agreement has not been signed at the global level and extradition of criminals agreements are limited to regional agreements.
