شناسایی مولفه‌های ساماندهی رویه ‌های شبه قانونی کوله ‌بری و ته‌ لنجی در راستای پیشگیری از قاچاق کالا

زمینه و هدف: امروزه عدم ساماندهی رویه‌های شبه قانونی کوله‌بری و ته‌لنجی، اقتصاد کشور و نظام عدالت کیفری را با چالش روبرو کرده است. لذا پژوهش حاضر با هدف شناسایی مولفه‌های ساماندهی رویه‌های شبه‌قانونی کوله‌بری و ته‌لنجی در راستای پیشگیری از قاچاق کالا انجام‌شده است.روش: پژوهش پیش‌رو از نظر هدف کاربردی و به لحاظ ماهیت و نحوه گردآوری داده‌ها کیفی از نوع اکتشافی است. جمع‌آوری داده‌ها با استفاده از ابزار فیش‌برداری و مصاحبه نیمه ساختاریافته انجام شد. مشارکت‌کنندگان شامل خبرگان قضایی و انتظامی بودند که از میان آن‌ها به‌صورت هدفمند انتخاب و بعد از مصاحبه، داده‌ها در نفر دوازدهم به اشباع نظری رسید که برای تایید مولفه‌ها در سه مرحله از فن دلفی استفاده شد. همچنین تحلیل داده‌ها به شیوه تحلیل محتوا و تحلیل مضمون، انجام شد. برای اعتبارسنجی داده‌ها از راهبرد کنترل و بازبینی بیرونی استفاده شد.یافته‌های پژوهش: طبق یافته‌های پژوهش، تعداد 19 شاخص در قالب مولفه «تدوین فرایند و چگونگی کوله‌بری و ته‌لنج‌بری»؛ تعداد 12 شاخص در قالب مولفه «ویژگی مناطق مرزی»؛ تعداد 13 شاخص در قالب مولفه «ویژگی کالاهایِ کوله‌بری و ته‌لنجی» و تعداد 11 شاخص در قالب مولفه «ویژگی کوله‌بران و ته‌لنج‌بران» مورد شناسایی قرار گرفت.نتیجه‌گیری: به‌منظور پیشگیری از قاچاق بی‌رویه کالا و پایداری امنیت مرزها ناگزیر از سامان‌دهی رویه‌های شبه قانونی کوله‌بری و ته‌لنجی است. در این راستا لازم است هیئت دولت در ارتباط با «کوله‌بر و ته‌لنج‌بر»، «مناطق مرزی»، «کالاهایِ کوله‌بری و ته‌لنجی» و نیز «فرایند کوله‌بری و ته‌لنج‌بری» آیین‌نامه‌ای را در قالب «ساماندهی رویه‌های شبه قانونی کوله‌بری و ته‌لنجی» به تصویب برساند تا در آینده پدیده کوله‌بری و ته‌لنج‌بری، اقتصاد کشور را با چالش مواجه نسازد.

identifying the components of organizing the quasi-legal procedures of smuggling through backpacking and shipping to prevent goods smuggling

background and objective: today, the lack of organization of the quasi-legal procedures of smuggling through backpacking and shipping has faced the country’s economy and the criminal justice system with a challenge. therefore, the current research was conducted with the aim of identifying the components of organizing the quasi-legal procedures of smuggling through backpacking and shipping in order to prevent the smuggling of goods.method: in terms of its objectives the present study is of an applied research type and in terms of the nature and method of data collection it is qualitative and exploratory. data collection was done using a questionnaire and a semi-structured interview. the participants included judicial and law enforcement experts who were purposefully selected from among them and after the interview, the data reached theoretical saturation in the 12th person, which was used to verify the components in three stages of the delphi technique. also, data analysis was done by content analysis and theme analysis. external control and review strategy was used to validate the data.findings: according to the findings of the research, 19 indicators in the form of the component developing the process and how to backpacking and shipping;12 indicators in the form of the characteristics of border areas component; and 13 indicators were identified in the form of characteristics of backpackers and backpackers and 11 indicators were identified in the form of characteristics of backpackers and shippers.results: in order to prevent the illegal smuggling of goods and the stability of border security, it is inevitable to organize the quasi-legal procedures of backpacking and shipping. in this regard, it is necessary for the government board to approve a regulation in relation to backpackers and shippers, border areas, backpacking goods and shipping goods and backpacking and shipping process in the form of organizing the quasi-legal procedures of backpacking and shipping, so that in the future, the phenomenon of backpacking and shipping does not pose a challenge to the country’s economy.
