بایسته‌های آموزش ضابطین در تفتیش و بازرسی پلیسی

زمینه و هدف: تفتیش و بازرسی به عنوان مقدمه کشف جرم در فرایند عدالت کیفری دارای اهمیت می باشد و لذا ضابطه مندی و آموزش دقیق اصول منطبق با قانونِ عملکرد مجریان و مداخله ضابطین در حریم خصوصی، امری ضروری و هدف اصلی نگارش این مقاله است.روش تحقیق: پژوهش حاضر از نظر نوع کیفی و از جهت هدف کاربردی، از لحاظ روش اجرا، توصیفی - تحلیلی بوده و جمع‌آوری اطلاعات از طریق بررسی اسنادی و فیش‌برداری و با بهره‌گیری از منابع کتابخانه‌ای و مدارک پژوهشی موجود صورت گرفته است.یافته ها:  اصل اولیه که به عنوان وظیفه بنیادین ضابطین باید مورد توجه باشد حفظ حریم خصوصی اشخاص و ممنوعیت هر گونه مداخله و انجام تفتیش و بازرسی از یک سو و حفظ کرامت و شئون فردی و اجتماعی جامعه مدنی از سوی دیگر است، کنشگران نظام عدالت کیفری از جمله پلیس نیز با توجه به این ملاحظه بنیادین تنها در زمانی که مصلحت مهم و یا ضرورت قابل توجیه قانونی وجود داشته باشد می توانند با رعایت ضوابط قانونی نسبت به انجام تفتیش و بازرسی اقدام نمایند.نتیجه‌گیری: آموزش اصول بنیادین آیین دادرسی کیفری در راستای امنیت افزایی حریم خصوصی افراد و جلوگیری از مداخله غیرقانونی کنشگران اجرایی دستگاه نظام عدالت کیفری از طریق تفتیش و بازرسی امری لازم و ضروری تلقی و در ابعاد شکلی و ماهوی قابل تدوین و اجرا است. در این مسیر تدوین سیاستهای کلی آموزش حقوق، بازنگری منابع و متون آموزشی متناسب با تحولات تقنینی بویژه در امور مربوط به حریم خصوصی افراد و اجرای مستمر آن در طول دوره‌های خدمتی ضابطین و مبتنی بر ظرفیت های موجود در آیین دادرسی کیفری راهگشا خواهد بود.

Requirements for training officers in search and police inspection

Background and Aim: Investigation is important as a prelude to crime detection in the criminal justice process, and therefore discipline and accurate training of principles in accordance with the law of enforcement and interference of officers in privacy, is essential and the main purpose of writing this article.Research Method: The present study is descriptive-analytical in terms of qualitative type and applied purpose in terms of implementation method and data collection has been done through documentary review and filing and using the available library resources and research documents.Findings: The basic principle that should be considered as the basic duty of officers is to protect the privacy of individuals and prohibit any interference and conduct of inspections and inspections on the one hand and to preserve the dignity and individual and social affairs of civil society on the other. According to this fundamental consideration, the police can conduct inspections and inspections in compliance with legal criteria only when there is an important interest or justifiable legal necessity.Results: Teaching the basic principles of this criminal procedure in order to increase the security of individuals’ privacy and prevent illegal interference by the executive actors of the criminal justice system through inspection and inspection is considered necessary and can be formulated and implemented in formal and substantive dimensions. In this direction, formulating general policies for legal education, reviewing educational resources and texts in accordance with legislative developments, especially in matters related to the privacy of individuals and its continuous implementation during the service periods of officers and based on the existing capacities in criminal procedure will be helpful.
