ارائه چارچوب مرجع در فرآیند جرم ‌یابی دیجیتال مبتنی بر قوانین و استانداردهای جهانی

زمینه و هدف: امنیت دیجیتال از مهم‌ترین دغدغه کشورها است. اگر امنیت سایبری پیشگیری است، جرم‌یابی دیجیتال درمان است؛ هر دوبه‌یک اندازه از ارکان مهم امنیت دیجیتال هستند و شواهد دیجیتال در راستای بررسی حادثه یا پرونده قضایی نقش مهمی ‌دارند. هدف مقاله حاضر مطالعه قوانین و استانداردهای مرتبط به‌منظور چارچوب مرجع در فرآیند جرم‌یابی دیجیتال و کاربردی سازی مراحل آن است. روش: این پژوهش با رویکرد توصیفی-تحلیلی به روش فراترکیب با جست‌وجو، ارزیابی، ترکیب و تفسیر استانداردها، فرآیند جدیدی همگام با قوانین قضایی برای آزمایشگاه‌های جرم‌یابی دیجیتال ارائه می‌دهد. برای ارزیابی و اعتبار سنجی، این فرآیند را در بررسی 20 پرونده‌ استفاده گردید. در مجموع، بیش از 200 مقاله علمی مرتبط با حوزۀ جرم‌یابی دیجیتال به طور کلی بررسی شد، اما اکثر آن‌ها به عنوان غیر مرتبط با موضوع استانداردهای جرم‌یابی دیجیتال حذف شدند. در این کار از 18 مطالعه محققین استفاده شد که مستقیماً با موضوع مطالعه مرتبط بودند. یافته‌ها: یافته‌های این پژوهش شامل فرآیندی هفت مرحله‌ای و گردشکار آزمایشگاه جرم‌یابی دیجیتال است. این فرآیند خلاصه‌ای از یک اقدام واقعی درصحنه جرم، یک‌روند تخصصی در آزمایشگاه و یک سازوکار قضائی را به تصویر می‌کشد که مراحل آن آماده‌سازی، جست‌وجو و توقیف، حفظ و ایمن‌سازی، اکتساب داده، تجزیه‌وتحلیل، مستندسازی وگزارش، خاتمه و عودت اقلام است. نتایج نشان داد شواهد کشف‌شده با این روش می‌تواند پرونده‌ها را از سوءظن به محکومیت پیش ببرد. نتیجه‌گیری: این پژوهش رهنمودی برای افزایش قابلیت‌های تخصصی دستگاه‌های مجری قانون، استانداردسازی و ایجاد چارچوبی کامل و قانونی برای واحدهای جرم‌یابی دیجیتال با نگرش به سطح عمیق‌تری در هر مرحله است. فرآیند پیشنهادی طبق مبانی و ادبیات مرتبط با پژوهش و بررسی سایر استانداردها، تدوین‌شده و با اجرای آزمونه‌ای ارزیابی شده و برای اجرای قانون و آموزش کاربردی است.

providing a reference framework in the process of digital forensics based on global rules and standards

background and purpose: digital security is one of the most important concerns of countries. if cyber security is prevention, digital forensics is the cure. both are equally important pillars of digital security. digital evidence plays an important role in investigating an incident or a court case. the aim of this article is to study the related laws and standards in order to provide a reference framework in the process of digital forensics and the application of its steps.method: this research presents a new process for digital forensics laboratories with a descriptive-analytical approach in a meta-composite method by searching, evaluating, combining and interpreting standards. for evaluation and validation, we used this process in the review of 20 cases. in total, more than 200 scientific articles related to the field of digital forensics in general were reviewed, but most of them were excluded as not relevant to the topic of digital forensics standards. in this work, 18 studies of researchers were used, which were directly related to the subject of the study.findings: the findings of this research include a seven-step process and digital forensics laboratory workflow. this process depicts a summary of a real action at a crime scene, a specialized process in a laboratory and a judicial mechanism, whose stages are preparation, search and arrest, preservation and securing, data acquisition, analysis and analysis, documentation and reporting, termination and return of items. the results showed that the evidence discovered by this method can advance the cases from suspicion to conviction.conclusion: this research is a guideline for increasing the specialized capabilities of law enforcement agencies, standardization and creating a complete and legal framework for digital forensics units with a deeper level approach at each stage. the proposed process was developed according to the principles and literature related to research and review of other standards, and was evaluated by conducting tests and is applicable for law enforcement and education.
