حمایت کیفری از قلمرو حریم خصوصی فضای مجازی در تحقیقات پلیسی با نگاهی به مقررات ایران و اسناد بین‌المللی

زﻣﻴﻨﻪ و ﻫﺪف: با گسترش فضای مجازی، پیشگیری از نقض ﺣﺮﻳﻢ ﺧﺼﻮﺻﻲ نیز همواره مورد توجه پلیس و ضابطان قضایی در ماموریت‌های انتظامی و اطلاعاتی و قانون‌گذاران نظام‌های عدالت کیفری قرار گرفته است؛ بنابراین، ضابطان دادگستری، پلیس امنیت عمومی و پلیس فتا به موازات اقدامات تقنینی، باید با اتخاذ تدابیر پیشگیرانه، نقشی موثری در صیانت از امنیت حریم خصوصی در ماموریت‌های اطلاعاتی و تحقیقات مقدماتی ایفاء کنند.روش: این پژوهش از نوع کیفی و از حیث روش اجراء توصیفی-تحلیلی است. از این‌رو، داده‌ها  به‌شیوۀ اسنادی و سنجش مقررات بر پایۀ اسناد و منابع مکتوب  و نیز مطالعه و واکاوی دیدگاه‌های صاحب‌نظران حقوقی با ابزار فیش‌برداری جمع‌آوری و مورد تجزیه و تحلیل قرار گرفته است.یافته‌ها: با توجه به جرم‌انگاری نقض حریم خصوصی در فضای مجازی و اتخاذ رویکردها و تدابیر پیشگیرانه به‌منظور تامین امنیت حریم خصوصی، رویکرد اساسی ﺍﺳﻨﺎﺩ بین‌المللی دایر به حمایت از امنیت مکاتبات، مراسلات، داده‌ها و اطلاعات خصوصی کاربران و کنشگران در بستر فضای مجازی است و به‌طورکلی در اسناد بین‌المللی، به اجماع بین‌المللی به‌منظور صیانت و تامین امنیت کلیۀ ابعاد حریم خصوصی تاکید شده است.نتیجه‌گیری: علاوه بر اقدامات تقنینی و جرم‌انگاری نقض حریم خصوصی در فضای مجازی از سوی متولیان نظام عدالت کیفری، ﺗﻮﺟﻪ پلیس و ضابطان قضایی ﺑﻪ اقدامات و ﺗﺪاﺑﻴﺮ ﭘﻴﺸﮕﻴﺮانۀ انتظامی مبنی بر تحقق امنیت و امنیت مداری حریم خصوصی در اجرای ماموریت‌های سازمانی در این فضا ضروری بوده و در شناسایی و مقابله با مصادیق نقض حریم خصوصی در ماموریت‌های اطلاعاتی و انتظامی نقش موثری ایفاء می‌کنند و اسناد بین‌المللی نیز ممنوعیت نقض حریم خصوصی را مورد توجه جدی قرار داده است.

background and objectives: with the expansion of cyberspace, the prevention of 10-1 violations has always been the focus of police and judicial officers in law enforcement and intelligence missions and members of the criminal justice system; accordingly, identifying and explaining preventive protection measures to ensure privacy in iran’s criminal justice system and international instruments is undeniable.findings: the inviolability of the dimensions and security of privacy in cyberspace has been emphasized by users and the police in police missions and preliminary investigations, and the necessary criminal measures have been taken to criminalize cyberspace and appropriate criminal liability for violators of privacy have been charged and it is necessary to adopt preventive approaches and measures to ensure the security of privacy. the basic approach is based on protecting the security of correspondence, correspondence, data and private information of users and activists in cyberspace and in general the international consensus on the protection and security of all aspects of privacy is emphasized in international instruments. conclusion: in addition to legislative and criminal actions for violating privacy in cyberspace by the custodians of the criminal justice system, police and judicial officers actions and disciplinary measures to achieve security and privacy in the implementation of organizational missions in this space it is necessary and plays an effective role in identifying and dealing with instances of privacy breaches in intelligence and law enforcement missions, and international instruments have also given serious consideration to the prohibition of privacy breaches. therefore, it is necessary for judicial officers and public security police and fata police to play an effective role in protecting privacy in intelligence and preliminary investigation missions by taking preventive measures in parallel with legislative measures.
