بایسته‌های کشف جرائم اقتصادی با تاکید بر مشارکت نهادهای انتظامی و قضایی

زمینه و هدف: پیچیدگی جرائم اقتصادی و دغدغۀ روزافزون سیاست کیفری ایران در خصوص لزوم مقابلۀّ جدی این جرائم و کاهش میزان وقوع آن‌ها، به رویکرد چند نهادی در مبارزه با این جرائم ضرورت ویژه‌ای بخشیده است. افزایش حداکثری کشف جرائم اقتصادی و ترس بزهکاران مربوطه، هدف اساسی مشارکت میان نهادهای قضایی و انتظامی مانند پلیس امنیت اقتصادی است و هدف نگارندگان در این تحقیق  این بوده است تا با آسیب‌شناسی وضعیت قضایی و انتظامی کشف جرائم اقتصادی، نسبت به تبیین راهکارهای برون‌رفت از چالش‌های مطرح در مسیر مشارکت انتظامی قضایی در کشف این جرائم پرداخته شود.روش: نظر به ماهیت موضوع، پژوهش حاضر ازنظر گردآوری اطلاعات به روش اسنادی و از طریق مطالعات تحقیقات معتبر، کتب، مقالات، قوانین و مقررات موجود و آراء محاکم قضایی انجام شده است. اطلاعات به‌دست‌آمده به‌صورت توصیفی مورد تجزیه و تحلیل قرار گرفته است.یافته‌ها: آغاز فعالیت پلیس امنیت اقتصادی از سال 1398 و عدم ساماندهی تعامل آن با مراجع قضایی، چالش‌هایی را به همراه داشته است و مراجع قضایی کماکان به نهادهای اطلاعاتی متوسل می‌شوند. به نظر می‌رسد که نبود مقررات مرتبط با شیوه‌نامه عملکرد این نهاد در کنار کنشگران قضایی، اقدامات آن را در حد عنوان ضابط قضایی تنزل می‌دهد و مشارکت در اتخاذ اقدامات واکنشی، نسبت به جرائم اقتصادی را با ضعف اساسی روبه‌رو می‌کند.نتیجه‌گیری: افتراقی‌سازی شیوۀ کشف جرائم اقتصادی، با نظر به جرائم اقتصادی برخاسته از محیط اداری و جرائم اقتصادی برخاسته از محیط تجاریشغلی، آموزش قضایی به پلیس امنیت اقتصادی، تصویب الگوی جامع عملکرد مشارکت محور در قالب آیین‌نامه مشخص و تعیین وظایف و اختیارات متفاوت پلیس امنیت اقتصادی با سایر ضابطان قضایی از اهم نتایج است.

the complexity of economic crimes and the increasing concern of iran’s criminal policy regarding the increased risk of committing these crimes and reducing their incidence have made the multidisciplinary approach to combating these crimes particularly important. maximizing the discovery of economic crimes and the associated fears of criminals is a key objective of partnerships between law enforcement and law enforcement agencies such as the economic security police, however, multipliers should not lead to procedural division as well as unregulated participation. therefore, policejudicial partnership policymaking is an approach in which the integrity of the performance and specification of the tasks of each of these institutions in combating economic crime are pursued.methodology: depending on the nature of the subject, the present study was conducted through documentary methodological studies, through studies of valid research, books, articles, laws and regulations, judicial opinions, and reputable websites. the information obtained is descriptively analyzed.findings: the beginning of economic security police activity in 1398 and its increasing interaction with the judicial authorities has posed some challenges. the absence of rules governing the institution’s style of conduct with judicial actors appears to diminish its actions as a matter of judicial authority and complicate participation in the response to economic crime.results: differentiate economic crime discovery method with respect to economic crime arising from administrative environment and economic crime arising from businessoccupational environment, judicial training to economic security police, adoption of a comprehensive participatorycentered pattern of practice in the form of specific bylaws, and assignment of duties and powers. differences in economic security with other judicial officers are of great importance.
