چالش‌های رعایت حقوق شهروندی متهم در فرآیند جرم ‌یابی

زمینه و هدف: ضابطان دادگستری در انجام فرایند جرم ‌یابی با چالش رعایت حقوق شهروندی متهمان و برقراری نظم امنیت مواجه هستند که این تحقیق با هدف شناسایی چالش‌های حقوق شهروندی متهم در فرآیند جرم‌یابی تدوین شده است.روش: تحقیق حاضر از نظر نوع و هدف کاربردی و از نظر روش، توصیفی - تحلیلی و از نظر ماهیت داده‌ها، کیفی بوده که جامعه آماری تحقیق شامل دو طیف، مصاحبه با نخبگان پلیس و اساتید حقوقی به تعداد 20 نفر در قالب پنل خبرگی و طیف دوم شامل تعداد جامعه آماری 114 نفر که متشکل از روسا و معاونین ادارات کلیه پایگاه‌های یازده‌گانه آگاهی تهران بزرگ و معاونین لایه اول مدیران پلیس آگاهی و پیشگیری ناجا که تعداد 72 نفر به‌صورت نمونه‌گیری هدفمند مورد استفاده قرار گرفت.یافته‌ها: یافته‌های پژوهش حاکی است که بیشترین چالش‌ها مربوط به فرآیند قضایی بوده از جمله عدم دسترسی فوری به مقامات قضایی و عدم حمایت قانونی و مناسب از ضابطان دادگستری بوده و کمترین چالش‌ها مربوط به فرآیند مدیریتی ازجمله کمبود امکانات و تجهیزات نهاد کشف جرم و عدم ارائه آموزش‌های فنی و تخصصی کشف جرم به ضابطان دادگستری است.نتیجه‌گیری: چالش‌ها عمدتاً مربوط به مرحله دستگیری و تحت نظر پلیسی به تعداد 107 کد اولیه و تعداد 58 تم فرعی مورد شناسایی که در قالب 4 تم اصلی (قانونی، قضایی، اجرایی پلیس، مدیریتی ناجا) مورد تحلیل قرار گرفته‌اند. به نظر می‌رسد بهترین راهکار رعایت حقوق شهروندی متهم، کسب آموزش‌های تخصصی و فنی لازم در حوزه جرم یابی و کشف جرم با توسل به فنون تحصیل ادله قانونی و مشروع رفع ابهامات فعلی قانونی و حفظ تعاملات قضایی بخصوص در جرائم مشهود است.

Challenges of respecting the citizenship rights of the accused in the criminalization process

Background and Aim: Police officers as judicial agents face the challenges of citizenship rights of accused individuals during do their responsibilities. The current study is to identify challenges of respecting the citizenship rights of the accused in the criminalization process.Methodology: The present paper was applied in terms of purpose and descriptiveanalytical in terms of method and qualitative in terms of the nature of the data. The statistical population included 20 police officers which in that period of time, they were authorities in police and had been selected by purposeful sample. A semistructured interview was used as a data collection tool.Findings: The findings indicate that at first step of crime detection have been identified and analyzed 107 primary code, 58 subthemes and 4 main themes. Among them, the most challenges related to the judicial process, including lack of immediate access to judicial authorities and lack of legal and appropriate protection of police officers, and the least challenges related to the management process, including lack of facilities and equipment and lack of technical training of crime detection to police officers.Conclusion: The results show that the best solution to respect the citizenship rights of the accused is to provide the necessary specialized and technical training by resorting to the techniques of studying legal and legitimate evidence and removing current legal ambiguities and maintaining judicial interactions, especially in crimes.
