چالش‌های امنیتی- انتظامی فرقۀ «اِکنکار» و سیاست‌ جنایی مقابله با آن در ایران

زمینه و هدف: شکل گیری و توسعۀ فرقه ها و جنبش های نوظهور فکری و دینی، چالش‌های امنیتی انتظامی اکثر کشورها، به‌ویژه ایران است که فرقۀ اکنکار یکی از آن‌هاست. پژوهش حاضر در نظر دارد ضمن تبیین چالش‌ها و پیامدهای امنیتی انتظامی این فرقه‌ها و فرقۀ اکنکار، راهکارهایی را  در قالب سیاست جنایی برای مقابله و پیشگیری از شکل‌گیری و توسعۀ آنها در پرتو اقدامات پلیسی قضایی ارایه کند.روش: این پژوهش از لحاظ هدف، کاربردی و از نظر ماهیت، توصیفی - تحلیلی با استفاده از اسناد و اطلاعات کتابخانه‌ای است. شیوۀ جمع‌آوری اطلاعات نیز فیش‌برداری بوده است.یافته‌ها: فرقۀ‌ اکنکار در تعارض آشکار با ارزش‌های دینی و هنجارهای اجتماعی ایران است که آگاهی پایین افراد جامعه به‌ویژه قشر جوان و خلاء قانونی در مقابله با فرقه‌ها و جنبش‌های نوظهور، زمینۀ بسیاری از مسائل امنیتی انتظامی را فراهم کرده و چالش‌هایی را برای کشور ایجاد خواهند کرد.نتیجه‌گیری: عدم وجود قوانین مناسب و نیز عدم تبیین حدود وظایف نهادهای دولتی و غیردولتی در ارتباط با فرقۀ اکنکار موجب شده است تا اقدامات فرهنگی، پیشگیرانه و مقابله‌ای مناسبی اتخاذ نشود و گاهی این اقدامات با موازی‌کاری نهادهای مختلف به‌صورت غیرمنسجم انجام ‌شود. اتخاذ سیاست جنایی در قالب تدوین «قانون جامع پیشگیری و مبارزه با هرگونه ناهنجاری دینی و فکری» با تبیین نقش و وظایف نهادهای دخیل و اعطای اختیارات به پلیس و قوۀ قضائیه برای اجرای تدابیر پیشگیرانه و مقابله‌ای ضروری است.

Security- policing challenges of Eckankar current and I.R of Iran’s Criminal Policy against Them

Background and Aim: Most countries in the world especially Iran are engaged in security policing challenges of sects and emerging intellectual and religious movements,  which eckankar is one of them. The present study is to identify security policing challenges and consequences of these currents in order to give  the solutions in a form of criminal policy for preventing and countering the formation and development of aforementioned movements in the matters of policing – judiciary  measures.Methodology: The current research was applied in terms of purpose and descriptiveanalytical which using library documents and data, and collecting of information had performed in taking note method. Findings: The eckankar sect is in clear conflict with the religious values and social norms of Iran which low level information of people in this regards specially among youths and lack of proper regulation for countering these emerging currents lead to lots of security policing challenges.Conclusion: The lack of appropriate law making and no cooperation in responsibilities of governmental and nongovernmental sectors regarding eckankar have not caused proper cultural, preventative and countering measures. It is necessary to legitimize a comprehensive law for preventing and combating with religious and intellectual disorders. According to the duties of related institutions, more power should be given to police and judiciary system for preventing and countering measures.
