گفتمان‌های متعارض قانون‌گذار و برنامه‌های پلیسی در کنترل سوءمصرف موادمخدر

زمینه و هدف: سیاست جنایی در حوزۀ مبارزه با مواد ‌مخدر با گفتمان‌های متعارضی اعم از تسامح صفر و تخفیف مواجه است که هر یک از آن‌ها روش‌های متفاوتی را برای مقابله و کنترل سوءمصرف مواد مخدر پیشنهاد می‌کنند که در این تحقیق در نظر است، گفتمان‌های متعارض قانون‌گذار و برنامه‌های پلیسی در کنترل سوء‌مصرف مواد ‌مخدر مورد بررسی قرار گیرد.روش: تحقیق حاضر از نظر هدف، کاربردی، از نظر روش اجرا، توصیفی تحلیلی و از نظر گردآوری اطلاعات، اسنادی است که اطلاعات موردنظر از کتب، قوانین، پایان‌نامه‌ها، مقالات و منابع اینترنتی جمع‌آوری شده و مورد تحلیل قرار گرفته‌اند.یافته‌ها: سیاست جنایی تقنینی که رکن اساسی مبارزه با جرائم است، در خصوص سوء‌مصرف مواد مخدر از انسجام لازم برخوردار نبوده و همین امر سبب شده است که برنامه‌های اجراشدۀ پلیس در طرح‌های مختلف جمع‌آوری معتادان متجاهر و عرضه‌کنندگان مواد مخدر توفیق چندانی به‌ دست نیاورد و این عدم انسجام و گفتمان‌های متعارض نیز ناشی از تعدّد و کثرت مراجع تقنینی در حوزۀ مبارزه با مواد مخدر، سنت‌گرایی و عدم تخصص و اعمال ملاحظات سیاسی در وضع قانون است.نتیجه‌گیری: با توجه به گفتمان‌های متعارض حاکم بر مبارزه با سوءمصرف مواد، باید با تعریف یک سیاست جنایی منسجم برای پلیس، این نهاد به‌محض روبرو شدن با هر نوع جرمی از جرائم مرتبط با مواد مخدر بلافاصله وارد عمل شده و نباید منتظر ارتکاب جرمی در ارتباط با مواد مخدر بماند و در بعضی مکان‌های جرم‌خیز با هر نوع تخلف جزئی که بعداً زمینه‌ساز جرائم مواد مخدر می‌شود، برخورد قاطع داشته باشد.

Conflicting legislative discourses and police programs in controlling drug abuse

Background and Aim: Antinarcotics criminal policy is confronted with conflict of discourses such as zero tolerance, mitigation which aforementioned issues have suggested different methods in order to combat with drugs. The purpose of this paper is to review, conflict between discourses of legislator and Police measures against drugs.Research Methodology: The present research is applied in terms of purpose functional, in terms of implementation method, analytical and in terms of data collection, documentary in which information related to books, laws, dissertations, articles and Internet resources have been collected and examined.Findings: Legislative criminal policy, which is the main base of the fight against crimes, has not been sufficiently coherent with regard to drug abuse, and it has been caused police measures implemented in various missions to collect high risk addicts and drug dealers to be less successful. Incoherence and conflict of discourses are also due to the multiplicity of legislative authorities related to counternarcotics, traditionalism and lack of expertise and the application of political considerations in lawmaking.Conclusion: According to the conflict of discourses in the fight against drugs, by defining a coherent criminal policy for the law enforcement force, police should act immediately upon encountering any types of drugrelated crimes and do not wait for committing a crime in connection with drugs, in high crime areas must be treated decisively with any minor violations that later lead to drug crimes.
