بررسی تبعات نکاح اعضای نیروهای مسلح جمهوری اسلامی ایران با بیگانگان در فقه امامیه و حقوق موضوعه

براساس منابع فقه امامیه، کتاب، سنت و سیرۀ ائمۀ معصومین (علیهم‌السلام) و اجماع، یکی از موانع نکاح، شامل نکاح مسلمان با غیرمسلمان است، ولیکن در این منابع، مشخصاً به نکاح نیروهای مسلح با بیگانگان و آثار زیان‌بار آن اشاره نشده است. مهم‌ترین سوال این مقاله عبارت است از: «تبعات منفی نکاح اعضای نیروهای مسلح جمهوری اسلامی ایران با بیگانگان در فقه امامیه و حقوق موضوعه چیست؟». روش تحقیق در این مقاله، توصیفی و تحلیلی و ابزار گردآوری داده‌ها، ازطریق فیش‌برداری و کتابخانه‌ای است. در ادامه به نظر می‌رسد، نکاح با بیگانگان بر مبنای قاعده نفی سبیل منجر به تسلط کفار بر امور مسلمین، ایجاد بستر مناسب نفوذ در کشور در حوزه‌های فرهنگی، سیاسی، اقتصادی، امنیتی، سستی در امر جهاد و ایجاد اختلاف بین زوجین شده و درنتیجه نکاح این قشر با بیگانگان، بر مبنای قیاس اولویت، ازمنظر فقه و حقوق اسلامی به‌طریق‌اولی جایز نیست. یافته‌های پژوهش بر این مبناست که اقوال مختلف فقها در این زمینه بررسی گردیده و با عنایت به منابع فقهی به ادلۀ ممنوعیت نکاح با بیگانگان و تبعات منفی این نوع نکاح پرداخته شده است. در پایان به نظر نگارنده با توجه به اهمیت و حساسیت موضوع، قوانین موضوعه در این خصوص نیازمند اصلاح و بازنگری است.

Investigating the consequences of marriage of Iranian armed forces’ members with foreigners in Imamiyyah Jurisprudence and positive laws

According to the sources of Imamiyyah jurisprudence, the book, traditions, and the biography of Imams (AS) and consensus, one of the barriers to marriage includes Muslim marriage with nonMuslims, but these sources do not specifically mention marriage to foreigners and its harmful effects. The most important question of the study is: What are the negative consequences of the marriage of the members of the Islamic Republic of Iran’s armed forces with foreigners in Imamiyyah jurisprudence and positive laws?. The research method in this study is explanatory and data collection tool is library and library sampling. In addition, it seems that marrying with foreigners on the basis of Nafy alSabil (negation of any way) rule leads to the domination of infidels over Muslims’ affairs, the creation of a suitable basis for penetration into the country in the areas of culture, politics, economics, security, weakness in jihad, and the separation between couples. As the result, the marriage of this class with foreigners is not permissible on the basis of analogy of priority from the perspective of jurisprudence and Islamic law in the first place. The findings of the study indicate that various jurists have investigated in this field and on the basis of jurisprudential sources they have worked on the reasons of prohibition of marriage with foreigners and the consequences of this type of marriage. At the end, in the opinion of the researcher, regarding the importance of this issue, positive laws needs to be revised.
