نقش فرهنگ سازمانی پلیس در احترام به حقوق متهمان و بزه‌دیدگان جرایم پزشکی با تاکید بر قانون آیین دادرسی کیفری و اصول اخلاقی

زمینه و هدف: در عصر حاضر که خدمات فزاینده سلامت و اقدامات گسترده پزشکی تبعات حقوقی به ویژه در خصوص افزایش جرایم را منتج شده است، رعایت حقوق شهروندی و احترام به حقوق متهمان و بزه‌دیدگان در جرایم پزشکی از مسائل کلیدی نظام عدالت کیفری به شمار می رود. با توجه به تاثیر فرهنگ سازمانی بر عملکرد و رفتار نیروی پلیس، این پژوهش به بررسی نقش فرهنگ سازمانی پلیس در احترام به حقوق متهمان و بزه‌دیدگان جرایم پزشکی می‌پردازد و به اصول اخلاقی و تاثیر قانون آیین دادرسی کیفری بر این موضوع تاکید دارد.روش: تحقیق به شیوه کتابخانه‌ای و اسنادی انجام شده است. اطلاعات مورد نیاز از منابع مکتوب، قوانین و اسناد حقوقی گردآوری شد و با استفاده از روش تجزیه و تحلیل کیفی، داده‌ها بررسی شدند تا الگوها و ارتباطات میان فرهنگ سازمانی پلیس و حقوق شهروندی در جرایم پزشکی شناسایی شوند.ملاحظات اخلاقی: جنبه های اخلاقی مطالعات کتابخانه ای در تحقیق حاضر مورد توجه قرار گرفته است.یافته‌ها: فرهنگ سازمانی پلیس، بر پایه ارزش‌های مشترک و باورهای اخلاقی، نقشی موثر در حفظ حقوق متهمان و بزه‌دیدگان جرایم پزشکی ایفا می‌کند. اصول عدالت ترمیمی و رویکرد قانون آیین دادرسی کیفری در این زمینه حاکی از لزوم تعامل سازنده و انسانی پلیس با متهمان و بزه‌دیدگان است. قانون آیین دادرسی کیفری، ضابطان قضایی را به طور عام و به صورت موردی، ملزم به رعایت حقوق شهروندی و حفظ کرامت انسانی در تمام مراحل دادرسی می‌کند که این مهم بستری بایسته برای رسیدگی موثر و کیفی به جرایم پزشکی را در قلمرو صلاحیت و حوزه تعاملی پلیس فراهم می آورد.نتیجه‌گیری: تقویت فرهنگ سازمانی پلیس با تاکید بر اصول اخلاقی و در سایه آموزش‌های لازم، می‌تواند به تحقق عدالت ترمیمی و حمایت از حقوق متهمان و بزه‌دیدگان در جرایم پزشکی منجر شود. این امر نه‌تنها موجب افزایش اعتماد عمومی به نظام قضایی می‌شود، بلکه در کاهش تنش‌های اجتماعی و بهبود کیفیت تعاملات پلیس و شهروندان درگیر در پرونده های پزشکی تاثیرگذار است. بر این اساس مهم‌ترین رویکردها در پرورش فرهنگ سازمانی شامل تقویت زیرساخت ها و تخصصی سازی در نیروی پلیس، آموزش قانون‌مداری، تدوین شیوه نامه افتراقی رفتاری در خصوص جرایم پزشکی، نظام ارزشیابی عملکرد، نظام تشویق و تنبیه، ارزیابی فرایند پرورش فرهنگ سازمانی و حفظ فرهنگ سازمانی مطلوب بر اساس چشم انداز قانون آیین دادرسی کیفری شایان توجه است.

the role of police organizational culture in respecting the rights of accused and victims of medical crimes with an emphasis on the code of criminal procedure and ethical principles

background and aim: in today's era, when increasing health services and extensive medical measures have resulted in legal consequences, especially regarding the increase of crimes, the observance of citizen's rights and respect for the rights of accused and victims in medical crimes are among the key issues of the criminal justice system. considering the effect of organizational culture on the performance and behavior of the police, this research investigates the role of police organizational culture in respecting the rights of accused and victims of medical crimes and emphasizes the ethical principles and the effect of the criminal procedure law on this issue. methods: research has been done by library and documentary method. the required information was collected from written sources, laws and legal documents, and using the qualitative analysis method, the data were analyzed to identify patterns and connections between police organizational culture and civil rights in medical crimes. ethical considerations: the ethical aspects of library studies have been considered in the present research. results: the organizational culture of the police, based on common values and moral beliefs, plays an effective role in protecting the rights of accused and victims of medical crimes. the principles of restorative justice and the approach of the criminal procedure law in this field indicate the necessity of constructive and humane interaction of the police with the accused and the victims. the law of criminal procedure obliges judicial officers to respect citizen's rights and maintain human dignity in all stages of proceedings, which provides a necessary platform for effective and qualitative treatment of medical crimes within the jurisdiction and interactive field of the police. conclusion: strengthening the organizational culture of the police by emphasizing ethical principles and under the shadow of necessary training can lead to the realization of restorative justice and protection of the rights of accused and victims in medical crimes. in addition to increasing public trust in the judicial system, this is effective in reducing social tensions and improving the quality of interactions between the police and citizens involved in medical cases. accordingly, the most significant approaches to cultivating organizational culture include strengthening infrastructure and specialization within the police force, promoting adherence to the law, developing differentiated behavioral guidelines for medical crimes, establishing a performance evaluation system, implementing a reward and penalty system, assessing the process of fostering organizational culture, and maintaining a desirable organizational culture based on the vision of the code of criminal procedure.
