فعل زیانبار (خطای ورزشی) و شرایط تحقق آن در چهارچوب مسئولیت مدنی ناشی از حوادث ورزشی

زمینه و هدف: ورزش در عصر حاضر جایگاهی ویژه در جوامع بشری یافته و افزایش دامنه و تعدد روزافزون فعالیت‌های ورزشی را در سراسر جهان موجب شده است. در عین حال مخاطرات مربوط به عملیات ورزشی مختلف منجر به بروز صدمات و خسارات گوناگونی شده که رسیدگی به آن‌ها در چهارچوب مسئولیت مدنی را امری ضروری ساخته است. بر این اساس، مسئولیت مدنی ناشی از حوادث ورزشی، از جمله مباحث بسیار بااهمیت در حیطه حقوق ورزشی به شمار می‌رود. در این میان یکی از ارکان مهم مسئولیت مدنی ناشی از حوادث ورزشی، فعل زیانبار است که تمیز و تشخیص مفهوم، قلمرو و معیارهای آن اهمیت به سزایی در حل پرونده‌های مسئولیت مدنی دارد.روش: مقاله حاضر با استفاده از روش توصیفی تحلیلی و ضمن بهره‌گیری از منابع کتابخانه‌ای فعل زیانبار و شرایط تحقق آن را به عنوان یکی از ارکان مسئولیت مدنی ناشی از حوادث ورزشی حین عملیات ورزشی مورد بحث و بررسی قرار داده است.ملاحظات اخلاقی: در این مطالعه ملاحظات اخلاقی شامل اصالت، صداقت و امانتداری مورد توجه قرار گرفته است.یافته‌ها: با توجه به مبانی حقوقی و قوانین مربوطه به ویژه قانون مسئولیت مدنی و بند «ث» ماده 158 قانون مجازات اسلامی، اساساً فعل زیانبار مرادف با ارتکاب خطا و تقصیر است و معیار تشخیص آن، نقض مقررات یا عرف ورزشی در هر رشته، مغایرت مقررات ورزشی با موازین شرعی و نقض قرارداد ورزشی، خواهد بود.نتیجه‌گیری: فعل زیانبار یا تقصیر در حوادث ورزشی زمانی تحقق می‌یابد که از مقررات ورزشی، تعهدات قراردادی یا عرف حاکم بر رشته ورزشی تخطی شود یا اساساً مقررات یک ورزش با موازین شرعی در مغایرت باشد. تدوین قوانین جامع و دستورالعمل‌های روشن می‌تواند به کاهش ابهامات حقوقی، پیشگیری، تعیین دقیق مسئولیت‌ها و تسهیل در فرآیند جبران خسارت در حوادث ورزشی کمک شایانی نماید.

tortious act (sports fault) and its conditions of realization within the framework of civil liability

background and aim: sports have attained a prominent position in contemporary societies, leading to a significant increase in the scope and frequency of sporting activities worldwide. however, the risks associated with various sports operations have resulted in numerous injuries and damages, necessitatingtheir adjudication within the framework of civil liability. accordingly, civil liability arising from sportsaccidents has become a pivotal issue in the domain of sports law. among the key elements of civil liability for sports accidents is the tortious act, the identification and delineation of whose concept, scope andcriteria are crucial for resolving civil liability cases effectively.methods: the present article employs a descriptive-analytical method, utilizing library resources toexamine tortious acts and the conditions for their realization as one of the essential elements of civilliability arising from sports accidents during sports operations.ethical considerations: this study adhered to ethical considerations, including authenticity, honesty andintegrity, throughout its execution.results: based on legal principles and relevant laws, particularly the civil liability act and clause (c) ofarticle 158 of the islamic penal code, a harmful act is essentially synonymous with the commission offault or negligence. the criteria for identifying such an act include violations of regulations or customarypractices within a specific sport, inconsistency of sports regulations with islamic principles and breachesof sports-related contractual obligations.conclusion: a wrongful act or negligence in sports incidents occurs when there is a breach of sportsregulations, contractual obligations, or the established customs governing a specific sport, or when therules of a sport fundamentally conflict with islamic principles. developing comprehensive laws and clearguidelines can significantly reduce legal ambiguities, prevent disputes, precisely determine liabilities andfacilitate the process of compensation in sports-related incidents.
