نقش گسترش عدالت ترمیمی در آمیزش قواعد اخلاقی و حقوقی و بازسازی اجتماعی

زمینه و هدف: عدالت ترمیمی به‌عنوان رویکردی نوین در نظام‌های حقوقی معاصر، بر ترمیم آسیب‌های وارده بر قربانی، پاسخگویی مرتکب، و در مقیاس کلان افزایش سطح تعاملات مثبت شهروندان و تقویت و تعمیق ارتباطات مدنی تاکید دارد. این رویکرد با تکیه بر اصول اخلاقی ظرفیت مساعدی برای تعدیل قواعد سخت‌گیرانه حقوقی و افزایش ضریب قانون پذیری فراهم می آورد. هدف این پژوهش بررسی نقش توسعه عدالت ترمیمی در آمیزش و همگرایی قواعد اخلاقی و حقوقی و در امتداد آن تحقق بازسازی اجتماعی بر مبنای مسئولیت پذیری شهروندان است.روش: این پژوهش با استفاده از منابع کتابخانه ای و اسنادی و با رویکرد توصیفی-تحلیلی انجام می پذیرد. بر این اساس، داده‌ها از منابع کتابخانه‌ای مشتمل بر کتب، مقالات علمی، و گزارش‌ نهادهای ذی ربط گردآوری و در چارچوب مساله تحقیق، تحلیل می شوند.یافته‌ها: نتایج نشان می‌دهد که عدالت ترمیمی اصولی مانند بخشش، همدلی، بازسازی اعتماد، و عدالت توزیعی را در چارچوب های حقوقی نهادینه می‌کند. این رویکرد با تاکید بر ارزش‌های انسانی، تعارض میان قواعد اخلاقی و حقوقی را کاهش داده و زمینه را برای تعامل بیشتر این دو حوزه فراهم می‌کند. در مقایسه با عدالت کیفری، برنامه‌های عدالت ترمیمی موفقیت بیشتری در کاهش تکرار جرم، بازتوانی مرتکبان و بازسازی روابط اجتماعی داشته‌اند و به تعمیق سطح مناسبات اخلاقی جامعه نیز مساعدت خواهند نمود. در حال حاضر، فقدان چارچوب‌های قانونی جامع، نیروهای متخصص و آموزش دیده و تعارض با برخی اصول سنتی حقوقی، از موانع توسعه عدالت ترمیمی به شمار می‌آید.نتیجه‌گیری: گسترش عدالت ترمیمی فرصتی است برای تعمیق پیوند میان قواعد اخلاقی و حقوقی در جامعه، که خود می‌تواند به تحقق عدالت اجتماعی و انسانی‌تر کردن فرآیندهای حقوقی کمک کند و بازسازی روابط اجتماعی را میسر نماید. این پژوهش پیشنهاد می‌کند که با توسعه چارچوب‌های قانونی و تقویت آموزش عمومی و مهارت های تخصصی در زمینه اصول عدالت ترمیمی، از ظرفیت‌های آن برای کاهش تعارضات اخلاقی-حقوقی و ارتقای نظام حقوقی و اجتماعی کشور بهره‌برداری شود.

background and aim: restorative justice, as an innovative approach in contemporary legal systems, emphasizesrepairing harm caused to victims, ensuring offender accountability, and, on a broader scale, enhancing positivecitizen interactions and strengthening civil relationships. this approach, rooted in ethical principles, provides afavorable capacity for moderating rigid legal frameworks and increasing the acceptance of law. the aim of this studyis to examine the role of restorative justice development in blending and harmonizing moral and legal rules,ultimately achieving social reconstruction based on citizen responsibilitymethods: this research is conducted using library and documentary sources with a descriptive-analytical approach.accordingly, data are collected from library resources, including books, scientific articles, and reports from relevantinstitutions, and analyzed within the framework of the research problem.ethical considerations: in this study, ethical considerations including authenticity of the text, honesty, and integrityhave been observed.results: the findings reveal that restorative justice institutionalizes principles such as forgiveness, empathy, trustrebuilding, and distributive justice within legal frameworks. by emphasizing human values, this approach reducesconflicts between ethical and legal norms and fosters greater interaction between these domains. compared toretributive justice, restorative justice programs have demonstrated greater success in reducing recidivism,rehabilitating offenders, and rebuilding social relationships while also contributing to the deepening of ethicaldynamics within society. currently, the lack of comprehensive legal frameworks, trained professionals, andalignment with certain traditional legal principles pose significant challenges to the development of restorativejustice.conclusion: the expansion of restorative justice offers an opportunity to deepen the integration of ethical and legalnorms in society, contributing to the realization of social justice and the humanization of legal processes whilefacilitating the reconstruction of social relationships. this study suggests that by developing comprehensive legalframeworks, enhancing public education, and fostering specialized skills in the principles of restorative justice, itspotential can be leveraged to mitigate ethical-legal conflicts and improve the legal and social systems of the country.
