تحلیل مبانی اخلاق زیستی در جرم‌شناسی سبز

زمینه و هدف: جرم‌شناسی سبز مبتنی بر تجزیه و تحلیل مضرات زیست‌محیطی از منظر جرم‌شناسی یا استفاده از اندیشه‌های جرم‌شناسی در مسائل زیست‌محیطی است و نزدیک به سه دهه است که در مورد جرائم زیست‌محیطی، مرتکبین جرائم و انگیزه‌های آنان، قربانیان این جرائم و نحوه بزه‌دیدگی آن‌ها و همینطور در خصوص برخورد و پیشگیری از این جرائم، فعالیت می‌کند. این مطالعه با هدف تحلیل مبانی اخلاق زیستی در حیطه جرم شناسی سبز به انجام رسید.روش: در این مطالعه به صورت تحلیلی، پس از جستجوی هدفمند و مرور منابع به تبیین مولفه‌های اخلاقی جرم‌شناسی سبز پرداخته شده است.ملاحظات اخلاقی: هنجارهای مربوط به اخلاق در پژوهش و نیز امانتداری در استناد به متون و ارجاعات مقاله به طور کامل رعایت گردیده است.یافته‌ها: تحلیل مولفه‌های جرم‌شناسی سبز از نظر مبانی اخلاق زیستی ارائه‌شده از سوی «بیوچامپ» و «چیلدرس» می‌تواند گام موثری در شناسایی و محک رسالت اخلاقی این رشته تقریباً نوظهور به حساب آید. تطبیق اصول چهارگانه اخلاقی زیستی، خودمختاری، عدالت، فایده‌رسانی و نازیان‌مندی با مبانی جرم‌شناسی سبز و رویکردهای سه‌گانه فلسفی انسان‌محورانه، زیست‌محورانه و طبیعت‌محورانه آن همگرایی بین اخلاق زیستی و جرم‌شناسی سبز را به اثبات رسانده است. رویکردهای سه‌گانه فلسفی جرم‌شناسی سبز نیز در تطبیق با اصول چهارگانه اخلاق زیستی جایگاه ممتازی دارند؛ با این تفاوت که در رویکرد انسان‌محور به جرم‌انگاری فعالیت‌های مغایر با آزادی و سودمندی انسان‌ها می‌پردازد و رویکرد زیست‌محور انسان را یک گونه از گونه‌های حیوانی معرفی کرده و رفتارهای مخل زیست گونه‌های مختلف جاندار را جرم‌انگاری نموده است و رویکرد طبیعت‌محور نیز با توسعه شعاع جرم‌انگاری به فعالیت‌هایی که در تضاد با منافع جهان طبیعت است، اعم از جاندارانی نظیر حیوانات و گیاهان، کره زمین و فضای بالای سر آن به محافظت از زیست کره می‌پردازد.نتیجه‌گیری: تحلیل مولفه‌های اخلاقی جرم‌شناسی سبز و تطبیق آن با قواعد اخلاق کاربردی مبین اهمیت و فایده آن در زمان کنونی است که در عین جدیدبودن باید مورد توجه قرار بگیرد.

analyzing the basic of bioethics in green criminology

background and aim: green criminology is the analysis of environmental harms from the perspective ofcriminology and the use of criminological ideas in environmental issues, and for nearly three decades, ithas been studying environmental crimes, the perpetrators of crimes and their motives, the victims of these crimes and how they are victimized, and also about dealing with and preventing these crimes. this study was done with the aim of analyzing the basics of bioethics in the field of green criminology.methods: in this analytical study, after a purposeful search and review of sources, the ethical componentsof green criminology are described.ethical considerations: the norms related to ethics in research as well as fidelity in quoting texts and references of the article have been fully observed.results: analyzing the components of green criminology in terms of the basic of bioethics presented by beauchamp and childress can be considered an effective step in identifying the ethical mission of this emerging field. adapting the four principles of bioethics, autonomy, beneficence, non-maleficence, and justice, with the basics of green criminology and the three philosophical approaches of human-centered, bio-centered, and nature-centered has proven the convergence between bioethics and green criminology.the three philosophical approaches of green criminology also have a privileged position in matching withthe four principles of bioethics; with the difference that in the human-centered approach, it deals with thecriminalization of activities contrary to the freedom and usefulness of humans, and the bio-centeredapproach introduces humans as one of the animal species and criminalizes the destructive behaviors ofdifferent living species, and the nature-centered approach, by expanding the radius of criminalization toactivities which is in conflict with the interests of the natural world, including living things such asanimals and plants, the earth and the space above it, protects the biosphere.conclusion: the analysis of the ethical components of green criminology and its application to the rules of applied ethics shows its importance and benefits in the present time, which while being new, should be considered.
