حمایت از اشخاص تراجنسیتی در پرتو سند ملی حقوق کودک و نوجوان

زمینه و هدف: سند ملی حقوق کودک و نوجوان تدابیر پیشگیرانه ضد بزه‌دیدگی و حمایتی را نسبت به کودکان و نوجوانان تبیین نموده که یکی از گروه‌های مورد حمایت این قانون، تراجنسیتی‌ها هستند. اشخاصی که میان هویت جنسی و جنسیتی آنان تطابق وجود ندارد و مطابق قوانین داخلی هم‌اکنون به عنوان بیماران دارای اختلال روانی محسوب می‌گردند. کودکان و نوجوانان تراجنسیتی در سراسر دنیا با سوءرفتارهای گسترده‌ای مواجه هستند، به طوری که رشد جسمی، روحی، معنوی، اخلاقی و اجتماعی آنان را به شدت تحت تاثیر قرار می‌دهد. این مقاله به مهم‌ترین حمایت‌های حقوقی مندرج در سند موصوف ناظر بر این اشخاص می‌پردازد.روش: روش تحقیق به صورت توصیفی تحلیلی می‌باشد و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای بوده است.ملاحظات اخلاقی: در انجام تمامی مراحل نگارش پژوهش حاضر، صداقت و امانتداری به همراه حفظ اصالت متون رعایت شده است.یافته‌ها: مطابق نسخه 11 دستورالعمل دسته‌بندی جهانی بیماری‌های سازمان جهانی بهداشت با وجود تغییر وضعیت اشخاص تراجنسیتی از فهرست «بیماری‌های روانی» به دسته «وضعیت سلامت جنسی» از ابتدای سال 2022، اما کماکان در بیشتر کشورها اشخاص تراجنسیتی در فهرست بیماران دارای اختلال روانی قرار دارند که در موقعیت حقوقی کنونی، سند ملی حقوق کودک و نوجوان می‌تواند نقش موثری در بهبود وضعیت کودکان و نوجوانان تراجنسیتی کشورمان ایفا نماید.نتیجه‌گیری: سند ملی حقوق کودک و نوجوان دربردارنده نقشی بی‌بدیل و جایگاهی ممتاز در میان قوانین حوزه کودک و نوجوان است، چراکه از منظر بین‌المللی، این سند مبنای معرفی و تبیین جایگاه کودکان و نوجوانان در مجامع بین‌المللی است. از منظر داخلی نیز کلیه دستگاه‌های مرتبط با امور کودکان و نوجوانان طبق وظایف باید با اتخاذ تدابیر قانونی در تصمیمات و برنامه‌ریزی‌های مربوطه، مواد مندرج در این سند را اعمال نمایند. اجرای تدابیر و حمایت‌های حقوق بشری این سند نه‌تنها منجر به جلوگیری از سوءرفتار با کودکان و نوجوانان تراجنسیتی و پرورش جسمی، روحی، معنوی، اخلاقی و اجتماعی آنان در بستری صحیح می‌گردد، بلکه منتج به افزایش سطح رعایت حقوق بشر و ارتقای اعتبار بین‌المللی کشور نزد افکار عمومی جهانی خواهد شد.

background and aim: the national document on the rights of the child and adolescent explains preventivemeasures and protections which one example protected by this law are transsexual children and adolescents.individuals who do not match their sexual and gender identities and they are now considered patients with mental disorders under domestic law. transsexual children and adolescents around the world face widespread abuse that severely affects their physical, mental, spiritual, moral and social growth. this article discusses the most important legal protections contained in the document governing these individuals.methods: the research method is descriptive-analytical and the data collection method has been library.ethical considerations: in order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.results: according to version 11 of the world health organization's forthcoming international classification ofdiseases, transsexual persons have been on the list of mentally ill people since the beginning of 2022, but in most countries transsexual persons are still on the list of mental disorders. in the current legal situation, the national document on the rights of the child and adolescent can play an effective role in improving the situation of transsexual children and adolescents in our country.conclusion: the national document on the rights of the child and adolescent contains an irreplaceable role and a privileged position among the laws in the field of children and adolescents. internationally, this document is the basis for introducing and explaining the position of children and adolescents in international forums. in terms of domestic law, all agencies related to the affairs of children and adolescents, according to their duties, must apply theprovisions of this document by taking legal measures in the relevant decisions and planning. the implementation of human rights measures and protections in this document not only leads to the prevention of abuse of transsexual children and adolescents and their physical, mental, spiritual, moral and social upbringing in a proper context, butalso leads to raises the level of human rights and enhances the international credibility of the state in world public opinion.
