اخلاق زیستی و حقوق بشر در شکل‌گیری نظام حقوق بهداشت جهانی

زمینه و هدف: بهداشت جهانی یک مفهوم بسیار مهم می‌باشد که تمرکز اصلی آن بر جهانی‌سازی بهداشت فردی و عمومی (به طور خاص در کشورهای در حال توسعه و کمترتوسعه‌یافته) و دسترسی به عدالت بهداشتی برای همه مردم در سراسر جهان است، در نتیجه این مفهوم غالباً معادل با بهداشت عمومی و جدای از حوزه حقوق بشر و اخلاق زیستی در نظر گرفته می‌شود. این مطالعه با هدف بررسی تاثیر هنجارهای اخلاق زیستی و حقوق بشر در شکل گیری نظام حقوق بهداشت جهانی انجام شد.روش: این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی تحلیلی می‌باشد و روش جمع‏آوری اطلاعات به صورت کتابخانه‏ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: نظام‌های حقوقی توسط هیچ کس تاسیس نمی‌شوند، واقعیت این است که نظام‌های حقوقی مجموعه‌ای از ارتباطات بازیگران مختلف است که در بطن آن فرآیندهای هنجارسازی و مسئولیت‌پذیری وجود دارد. نکته دیگری که باید در نظر داشت، این است که در یک نظام حقوقی هدف اصلی، تحمیل وحدت بر کثرت نیست، زیرا این امر تقریباً غیر ممکن است. در واقع هدف اصلی ساختن هویت با کمک هنجارهای حقوقی می‌باشد؛ امری که در شکل گیری نظام حقوق بهداشت جهانی قابل تامل است.نتیجه‌گیری: در پرتو رویکرد ناشی از نظریات کثرت‌گرایی حقوقی جهانی، تحولات اخیر در حقوق پزشکی بین‌المللی و اخلاق زیستی، یک گام مهم در شکل‌گیری نظام حقوقی بهداشت جهانی را تشکیل می‌دهد. به تعبیری، هنجارهای حقوق بشر در رشد استقلال اساسی و سازمانی بهداشت جهانی، نقش اصلی را ایفا می‌کنند.

bioethics and human rights in the formation of theglobal health rights system

background and aim: global health is a very important concept whose main focus is on the globalization of individual and public health (especially in developing and less developed countries) and access to health justice for all people around the world. as a result, this concept is often considered equivalent to public health and separate from the fields of human rights and bioethics.this study was conducted with the aim of investigating the impact of bioethical norms and humanrights in the formation of the global health rights system.methods: this research is of theoretical type and the research method is descriptive-analytical andthe method of data collection is library which has been done by referring to documents, books and articles.ethical considerations: in order to organize this research, while observing the authenticity of thetexts, honesty and fidelity have been observed.results: legal systems are not established by anyone; the fact is that legal systems are a set of connections between different actors in which there are processes of normalization and accountability. another point to keep in mind is that in a legal system the main goal is not to impose unity on plurality because it is almost impossible. in fact, the main goal is to build an identity with the help of legal norms; something that can be considered in the formation of the global health rightssystem.conclusion: in the light of the approach resulting from theories of global legal pluralism, recentdevelopments in international medical law and bioethics are an important step in the formation of theglobal health legal system. in other words, human rights norms play a key role in the development of fundamental and organizational independence of global health.
