تجزیه و تحلیل منع سوءاستفاده از حق در جریان آزاد اطلاعات از منظر نظام بین‌الملل حقوق بشر

زمینه و هدف: در نظام بین‌الملل حقوق بشر، حق دریافت و نشر اطلاعات، از جمله حقوق بنیادین بشر برشمرده شده است، ولی مطابق اسناد حقوق بشری این حق، مطلق نبوده و با شرایط، ضوابط و محدودیت‌هایی همراه است. هدف پژوهش حاضر، یافتن شیوه‌های منع سوءاستفاده از حق در جریان آزاد اطلاعات است.روش: تحقیق حاضر، مطالعه ای نظری است و با روش تحلیل کیفی محتوا، انجام شده است. روش جمع‏آوری اطلاعات به صورت کتابخانه‏ای بوده و با مراجعه به اسناد، کتب و مقالات انجام گرفته است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: اصل منع سوءاستفاده از حق، خواه به عنوان جزئی از اصل حسن نیت یا قاعده لاضرر و خواه به عنوان اصلی مستقل، محدودکننده جریان آزاد اطلاعات و استثنایی بر حق دریافت و انتشار اطلاعات است. بر این اساس، باید خوانشی مضیق و دقیق از آن ارائه نمود تا نقش مخدوش‌کننده آزادی بیان را ایفا ننماید، چه اینکه طبق یک ضابطه کلی، سوءاستفاده از حق، در مقام تحدید حق دریافت و انتشار اطلاعات زمانی قابل استناد است که مطابق استاندارهای جوامع مردم‌سالار و در قوانین موضوعه آورده شده باشد.نتیجه‌گیری: نوشتار پیش رو، با توجه به انتزاعی و سیال‌بودن مفهوم سوءاستفاده از حق، ضمن تلاش برای رهیافتی دقیق‌تر به مفهوم اصل یاد شده، معیارهایی چون سوءنیت و عدول از غایت اجتماعی حق را به عنوان ملاک‌های سوءاستفاده از حق دریافت و نشر اطلاعات بررسی نموده و معیار «زیان آگاهانه نامتعارف» را بدین منظور پیشنهاد داده است. از دیدگاه نوشتار حاضر سوءاستفاده از حق دریافت و انتشار اطلاعات تنها هنگامی رخ می‌دهد که یک فرد، سازمان و یا کشور در جریان آزاد اطلاعات با آگاهی کامل به گونه‌ای رفتار نماید که منجر به زیان نامتعارف به دیگران شود.

analysis of the prohibition of abuse of the right to the free flow of information from the perspective of the international human rights system

background and aim: in the international human rights system, the right to receive and publish information isconsidered one of the basic human rights, but according to human rights documents, this right is not absolute andcomes with conditions, criteria and limitations. the purpose of the current research is to find ways to prevent theabuse of the right to receive and publish information.methods: this research is of theoretical type and the research method is qualitative content analysis; the method ofdata collection is library which has been done by referring to documents, books and articles.ethical considerations: in order to organize this research, while observing the authenticity of the texts, honesty andfidelity have been observed.results: the principle of prohibiting the abuse of the right; whether as a part of the principle of good faith or theprinciple of harmlessness or as an independent principle, it limits the free flow of information and is an exception tothe right to receive and disseminate information. based on this, a narrow and precise reading of it should be given sothat it does not play the role of distorting the freedom of expression. under a general rule, the abuse of the right canbe cited as a limitation of the right to receive and disseminate information when it is stated in the relevant laws andin accordance with the standards of democratic societies.conclusion: the following article, considering the abstractness and fluidity of the concept of abuse of right, whiletrying to get a more precise approach to the concept of the mentioned principle, has reviewed criteria such as badfaith and deviation from the social goal of the right as the criteria of abuse of the right and proposed the criterion ofunconventional conscious damage for this purpose. so from the point of view of this article, abuse of the right toreceive and disseminate information occurs only when a person, organization or country behaves with fullknowledge in the free flow of information in a way that leads to unusual damage to others.
