قلمرو عقل در تشخیص مصادیق عدالت

حسن عدالت و قبح ظلم از احکام عقل عملی است که به دلیل اشتمال بر حفظ نوع و مصالح عامه، از قضایای عقلایی نیز محسوب می‌شود. بین حکم عقل و حکم شرع ملازمه وجود دارد. معیار قضیه اولی بودن، آن است که با تصور دو طرف قضیه، حکم صادر شود که این مسئله در مورد قضیه مذکور صادق است. در قضایای اولی، بحث از مطابقت با نفس الامر و واقع و یقین مطرح است. اما در قضایای عقلایی و آراء محموده، بحث از تطابق با آراء عقلا مورد نظر است. بنابراین مصادیق عدالت و ظلم باید بر اساس حق، یقین و قطع از طرف عقل تشخیص داده شود. هرگاه عقل با ادراک تام و کامل، مصلحت یا مفسده بدون مزاحم را در تشخیص مصداق عدل و ظلم کشف کرد، نظر او معتبر است.  

realm of reason in discernment of justice instances

seyed mohammad hashem pourmola* abdolali shokr** goodness of justice and badness of evil are from injunctions of the practical reason that because of preserving human and public interests are also from rational propositions. there is inherence between injunction of reason and decree of the law. the criterion of primal proposition is that with imagine two sides of proposition, the injunction is issued, that in the former case, the issue is true. in the primal propositions, is argued about correspondence with actuality, reality and assurance; but in rational propositions and laudable opinions, correspondence with views of the wise is a foremost problem.  thus instances of justice and injustice must be detected on the basis of truth and certainty. whenever reason discovers interests or corruption without bothering in distinguish instance of justice and evil by a total and complete perception, his view will be valid.   * shiraz university, shiraz, iran          pourmola@shirazu.ac.ir. ** shiraz university, shiraz, iran        ashokr@rose.shirazu.ac.ir.
