مداقه‌ای در اعتباریت تشریعیات از منظر علامه طباطبائی و علامه حسن زاده آملی

اعتباریات مبحثی میان رشته ای است که در فلسفه، اصول فقه، علوم ادبی و زبان شناسی مورد بررسی قرار می گیرد، اما صبغه فلسفی و اصولی آن بسیار پر رنگ تر است. برجسته نمودن بحث اعتباریات و جمع آوری و انسجام مباحث مربوط به آن از نوآوری های علامه طباطبایی به شمار می آید. تطبیق بحث اعتباریات بر اموری مانند الزام و بایستن، جزاء و پاداش و همچنین اعتباریت تشریعیات و احکام الهی امری قابل تامل و شایسته غور و تحقیق بیشتری است. علامه بحث اعتباریات را در حوزه دین تسرّی داده و زبان دین و احکام الهی را زبان اعتبار معرفی نموده و تعلق اراده حاکم بر فعل غیر را اعتبار در اعتبار عنوان می کند. اما علامه حسن زاده معتقد است از آنجایی که تشریع از باطن تکوین منشا می گیرد، جزو امور اعتباری محسوب نمی شود. تشریع و تشریعیات در حقیقت تنظیم و تنقیح اسرار تکوینی و طبیعی تکامل انسان در مسیر صحیح الهی است. صراط مستقیم بودن تشریعیات از نظر علامه حسن زاده در عداد امور تکوینی است و حقیقتی نامشروط و مطلق محسوب می شود.

A Discussion on the Constructedness of Divine Legislation from the Perspective of Allameh Tabatabai and Allameh Hassanzadeh Amoli

One of the most important interpretive approaches, especially in the verses of narrative attributes, is the approach of allegorical interpretation. The Mutazilites and the majority of Shiites believe in the necessity of allegorical interpretation, but within the framework of special rules and regulations. On the other hand, the majority of Sunnis, including the Ahlulhadith, the Salafis and most of the Asharites are inclined toward exoteric meanings. Meanwhile, some contemporary Shiite theologians have taken a third approach by presenting a new theory that can be called &affirmative signification& and believe that insisting on the initial exoteric meaning and interpreting and changing the meaning of the verses are both incorrect. Rather, they should be understood based on their exoteric meaning, considering both verbal and nonverbal philosophical and rational evidences. Hence, without neglecting the exoteric meaning obtained from the sentence in accordance with the evidences, we can get the correct meaning and the real purpose of the author. Using analyticalcritical method based on library sources, the mentioned theory is examined and criticized in this article to find out whether it is really separate from the theory of allegorical interpretation or the same, but with two different expressions. Finally, it is concluded that the difference of the two theories in some terms of interpretation is superficial and verbal, technically speaking, not real and semantic
