گستره عقل عملی در حوزه قانون و اخلاق

این نوشتار، نخست توضیحی کوتاه دارد دربارهٔ خَلق و خُلق و قانون، و مدعی است که اگر قانون به طور صحیح و دقیق اجرا شود، عدالت اجتماعی و نظم برقرار می‌شود. عدالت اجتماعی معلول قانونمندی است، ولی عدالت اخلاقی معلول تعادل و توازن قوای نفسانی شهویه و غضبیه و نطقیه است . اگر عدالت اخلاقی تحقق یابد، عدالت اجتماعی به طور عمقی و ریشه‌ای تحقق می‌یابد ؛ ولی عدالت اجتماعی لزرماً همراه با عدالت اخلاقی نیست. عدالت اخلاقی مستلزم تحقق مکارم و معالی اخلاق است، و مکارم اخلاق که برخاسته از کرامت نفس است، از محاسن اخلاق که برخاسته از مصلحت اندیشی هاست، برتر است؛ از این رو معلوم می‌شود که گستره عقل عملی در حوزه قانون، محدود و در حوزه اخلاق، نامحدود است.

Functional intellect expanse in the domain of law and morality

Shokrollah Jahanmahin[1] This writing explains first briefly about creation, temperament and law and it claims that if law is executed correctly and exactly, will be established social justice and order. Social justice is effect of respect to law, but moral justice is effect of equilibrium and rational faculties. If moral justice is fulfilled, social justice will be fulfilled deeply and fundamental, but necessarily it is not in company with moral justice. Moral justice requires achievement of Nobel and eminences dispositions, and the Nobel dispositions that is caused by soul greatness is superior than morality virtues that is caused based on convenience. There for it’s obvious that functional intellect expanse is limited in the domain of law and it is unlimited in the morality one. [1]. Islamic Azad university, Jahrom, Iran .
