بررسی تطور کمک‌‌های بشردوستانه سازمان ملل و نقش آن در دستیابی به مفهوم یاری‎رسانی

سازوکارهای موجود در سازمان ملل متحد که مهم‌ترین مجری کمک‎های بشر دوستانه در سطح نظام بین‎الملل است، در فضای متاثر از پایان جنگ سرد به سرعت توسعه یافت. چنانکه قطعنامه‌های متعددی از سوی شورای امنیت، مجمع عمومی سازمان ملل و شورای اقتصادی و اجتماعی در زمینه کمک‎های بشردوستانه به‌‌تصویب‌‌رسید و نهادهای تخصصی، مانند دفتر هماهنگی امور بشردوستانه ایجاد شد. هنجارهای مربوط به حقوق بشردوستانه در نظام سازمان ملل متحد، دائماً در حال توسعه است. در این راستا، هدف پژوهش حاضر، اولاً، تبیین تطور نظام کمک‌‌های بشردوستانه سازمان ملل متحد و ثانیاً مروری بر نحوه عملکرد نظام فعلی موجود، در رابطه با فرایندهای تصمیم‌‌گیری در این سازمان است. همچنین، امتیازات و مصونیت‌‌های سازمان ملل متحد و آژانس‌‌های تخصصی را تشریح کرده و قوانین مربوط به ایمنی و حفاظت از پرسنل بشردوستانه را بررسی می‌‌نماید. بر این اساس پرسش اصلی پژوهش حاضر این است که فهم سیر تطور کمک‎های بشردوستانه چگونه می‎تواند در دستیابی به مقوله یاری‎رسانی در محیط‎های بحران‎زده اثرگذار باشد؟ با تبیین الگوهای کلی در نظام فعلی بشردوستانه سازمان ملل متحد، چارچوب قانونی کمک‌‌های بشردوستانه سازمان ملل متحد ترسیم شده و نشان داده شد که این سازوکار چگونه عمل می‌کند و سازمان ملل متحد به چه میزان در دستیابی به آن کامیاب بوده است. شناخت این سازوکارها می‎تواند در نوع ارتباط دولت‎ها با سازمان ملل متحد و کمیسیون‌های مرتبط با مقوله یاری‌رسانی موثر باشد و باعث توزیع عادلانه فرصت‎های حمایتی در محیط‌های آشوب‎زده و متاثر از جنگ شود. نظام بشردوستانه ملل متحد، در حال ساده‌سازی و یکپارچه‌‌سازی مداوم، به ویژه از طریق تاسیس دفتر هماهنگی امور بشردوستانه، در جهت تبدیل شدن به مرکز هماهنگی برای اقدامات امدادی سازمان ملل متحد است. مکانیسم‌‌های قانونی مربوط به انجام امور بشردوستانه، از امتیازات و مصونیت‌‌ها گرفته تا موافقت‌نامه‌‌های ویژۀ ایمنی و امنیت، موضوعی در حال تغییر بوده که ممکن است به اجرای بهتر اقدامات بشردوستانه کمک کند. با وجود این، به نظر می‌‌رسد ضروری است که مجمع عمومی و دبیرکل، تحت فشار مداوم دولت‌‌ها نسبت به تصویب کنوانسیون‌‌های ضروری و هماهنگ مربوطه و تضمین فعالیت و حمایت از بشردوستان، چه در درگیری‌‌های مسَلّحانه و چه در زمان فجایع طبیعی، تلاش بیشتری داشته باشند.

an examination of the evolution of united nations humanitarian assistance and its role in achieving the concept of relief

the existing mechanisms of the united nations, as the most significant executor of humanitarian assistance at the international level, rapidly expanded in the post-cold war era. numerous resolutions were adopted by the security council, the general assembly, and the economic and social council concerning humanitarian assistance, leading to the establishment of specialized institutions such as the office for the coordination of humanitarian affairs. norms related to humanitarian law within the un system are continually evolving. this study aims, first, to explain the evolution of the un’s humanitarian assistance system and, second, to review the operational aspects of the current system, particularly in decision-making processes. additionally, the study elucidates the privileges and immunities of the united nations and its specialized agencies while examining laws related to the safety and protection of humanitarian personnel. the central research question explores how understanding the evolution of humanitarian assistance can contribute to achieving the concept of relief in crisis-stricken environments. by delineating the general patterns within the current un humanitarian system, the study outlines the legal framework governing humanitarian assistance and evaluates the effectiveness of these mechanisms in fulfilling their intended objectives. understanding these frameworks can enhance the interaction between states and the united nations and its related commissions on humanitarian relief, ensuring the equitable distribution of aid opportunities in conflict-affected and war-torn regions. the un humanitarian system is undergoing continuous simplification and integration, particularly through the establishment of the office for the coordination of humanitarian affairs, which seeks to become the central hub for un relief efforts. legal mechanisms governing humanitarian activities, from privileges and immunities to specialized safety and security agreements, are constantly evolving and may contribute to improving humanitarian efforts. nevertheless, it appears necessary for the general assembly and the secretary-general to intensify their efforts—amid persistent state pressures—to adopt essential and coordinated conventions, ensuring the protection and support of humanitarian workers in both armed conflicts and natural disaster scenarios.
