کارکرد های اصالی عرف و فهم عرفی در سیاست و ساختار سیاسی با نگاهی به فقه شیعه

یکی از عرصه های مهمی که استفاده از عرف و میزان قلمروی آن، یا مغفول مانده و یا نگاه حداقلی به آن صورت گرفته است، عرصه سیاست و ساختار سیاسی می باشد. از این رو در پژوهش حاضر، کارکردهای اصالی عرف و فهم عرفی در سیاست و ساختار سیاسی با نگاهی به فقه شیعه مورد بررسی قرار گرفته است. در این راستا، و با روش تحلیلی، بعد از بیان - ادلّه حجّیت عرف و سیره، به اثبات نقش و کارکردهای اصالی عرف و سیره عرفی، در سیاست و ساختار سیاسی، با نگاه به فقه وادلّه فقه، پرداخته شده است. درنتیجه، مواردی مانند تشکیل حکومت، حاکمیت ملی، بیعت، انتخابات، پذیرش شورا و امربه معروف و نهی از منکر، ازجمله کارکردهای مهم و اصالی عرف در سیاست و فقه سیاسی معرفی شدند. همچنین نشان داده شد که در اعتبار فقهی عرف و سیره عقلاء، تردیدیوجود ندارد، به طوری که حجیّت آن از طریق دلایلی همچون سکوت شارع، امضایی بودن احکام در غیرعبادات، علم معصوم به آینده و تنقیح مناط، به اثبات می رسد. بنابراین، عرف و سیره، نقشی اصالی و مشروع، در سیاست و ساختار سیاسی دارد. نقش عرف در امور تقنینی اعم از بیان قانون، حد بیان قانون و تعدیل آن نیز، غیرقابل انکار بوده و در اعتبار عرف به عنوان یک منبع حقوقی، تردیدی وجود ندارد. حتی عرف حادث بعد از قانونگذاری نیز می تواند به عنوان یک منبع حقوقی تلقی شده و گاهی نیز به عنوان منبع تفسیری مورد استفاده قرار گیرد.

one of the significant areas where the utilization and scope of custom (ʿurf) have been either neglected or minimally explored is the domain of politics and political structure. this research investigates the intrinsic functions of custom and customary understanding in politics and political structure, focusing on shia jurisprudence. employing an interpretive-analytical method, the study presents the evidentiary basis for the legitimacy of custom and tradition (sunnah). subsequently, it aims to demonstrate the essential roles and functions of custom and tradition in politics and political structures through the lens of jurisprudence and its evidentiary framework. key aspects such as the formation of government, national governance, allegiance (bay'ah), elections, acceptance of consultation (shura), and enjoining good and forbidding evil are highlighted as essential and intrinsic functions of custom in politics and political jurisprudence. furthermore, the study emphasizes that there is no doubt regarding the jurisprudential credibility of custom and tradition, supported by reasons such as the silence of the legislator, the generality of legal injunctions beyond rituals, the infallible knowledge of the future, and the adaptability of legal principles. therefore, custom and tradition play an authentic and legitimate role in politics and political structures. the role of custom in legislative matters, including the formulation, specification, and modification of laws, is undeniable, and its status as a legal source is firmly established. even post-legislation, emergent custom can be considered a legal source and may sometimes serve as an interpretive tool.
