دکترین امنیت انسانی و تضمین حقوق بنیادین کارگران مهاجر

هدف پژوهش حاضر بررسی دکترین امنیت انسانی و تضمین حقوق بنیادین کارگران مهاجر است. در این راستا، در پاسخ به این سوال که امنیت انسانی چگونه می‌‌تواند موجب حمایت از حقوق بنیادین کارگران مهاجر شود؟ تحقق امنیت انسانی چگونه می‌‌تواند حقوق بنیادین کارگران مهاجر را ارتقاء و تضمین کند؟ ﻧﺴﺒﺖ ﺑﻪ ﺗﺎثیر دﻛﺘﺮﻳﻦ امنیت انسانی ﺑﺮ ارتقاء و تضمین حقوق بنیادین کارگران مهاجر، در ﻗﺎﻟﺐ ﻫﻔﺖ ﻣﻮﻟﻔﻪ تشکیلدﻫﻨﺪه ﻣﻔﻬﻮم امنیت اﻧﺴﺎﻧﻰ، ﺑﺎ اﺳﺘﻔﺎده از ﻇﺮفیت‌‌های ﻫﻨﺠﺎرى و ﻗﺎﻧﻮﻧﻰ ﻧﻈﺎم ﺣﻘﻮق ﺑﺸﺮ ﭘﺮداﺧﺘﻪ شده است. همچنین از اعلامیه ﻫﺰاره ﻣﻠﻞ ﻣﺘﺤﺪ ﻛﻪ ﺑﻪ ﻋﻨﻮان ﻧﻘﺸﻪ راه ﻫﺰاره ﺳﻮم ﻣﺤﺴﻮب ﻣﻰ‌‌ﺷﻮد و داراى ﻇﺮفیت ﺑﺎﻟﻘﻮه‌ای ﺑﻪ ﻣﻨﻈﻮر ﺗﺒﺪﻳﻞ شدن ﺑﻪ ﻋﺮف بین‌‌المللی ﻣﻰ‌‌ﺑﺎﺷﺪ، استفاده گردید. روش پژوهش توصیفی- تحلیلی بوده و نتایج نشان داد که امنیت انسانی به عنوان دکترینی که از حقوق بنیادین بشر حمایت می‌‌کند، می‌‌تواند موجب تضمین و ارتقاء حقوق کارگران مهاجر به عنوان قشری از جامعه جهانی که با چالش‌‌ها و مشکلات مختلفی روبرو هستند، گردد. در واقع، امنیت انسانی، تضمین‌کننده حقوق سیاسی، اقتصادی، اجتماعی، بهداشتی، غذایی، زیست محیطی و شخصی کارگران مهاجر در کشورهای مبدا و مقصد می‌‌باشد. همانطور که در این تحقیق بیان گردید، اسناد و معاهدات مختلف جهانی به صورت صریح و ضمنی، بر حقوق بنیادین کارگران مهاجر تاکید کرده‌‌اند، اما در عمل شاهد نقض این حقوق توسط دولت‌ها هستیم.

this research aims to examine the doctrine of human security and the guarantee of fundamental rights for migrant workers. in response to the question of how human security can support and guarantee the fundamental rights of migrant workers, human security is explored in promoting and ensuring the rights of migrant workers, particularly in the context of global challenges and various difficulties they face. the research utilizes a descriptive-analytical method, and the results indicate that human security, as a doctrine supporting fundamental human rights, can lead to the assurance and improvement of the rights of migrant workers, who constitute a segment of the global community facing various challenges and issues. human security guarantees the political, economic, social, health, food, environmental, and personal rights of migrant workers in both origin and destination countries. as outlined in this study, various international documents and treaties explicitly and implicitly emphasize the fundamental rights of migrant workers, yet in practice, we witness the violation of these rights by governments.
