صورت‌بندی حقوق مردم در حکومت اسلامی از منظر نائینی با تکیه بر کتاب «تنبیه الامّه»

هدف پژوهش حاضر بررسی حقوق مردم در حکومت اسلامی از منظر نائینی، با تکیه بر کتاب «تنبیه الامه» است. روش پژوهش کیفی-استقرائی بوده و در این راستا، ابتدا با مفهوم‌‌شناسی دقیق مفاهیم «حقوق»، «مردم» و «حکومت»، اساس و زیربنای مستحکمی برای افزایش عمق و دقت پژوهش بنیان نهاده شد. سپس در جهت تحلیل کلمات به استفاده از عبارات صریح نائینی اکتفا نکرده و از لوازم کلام ایشان نیز استفاده شد. از دیگر دستاوردهای این پژوهش، بررسی دقیق و جامع اصطلاحات و عباراتی بود، که در کلمات نائینی به‌کار برده شده‌‌اند؛ با شفاف‌سازی و تبیین این اصطلاحات، علاوه‌بر تحلیل عمیق‌‌تر، دسته‌‌بندی دقیق‌‌تری از حقوق نیز بدست آمد، نظیر آنچه در بررسی مفهوم «مساوات» و تبیین گستردگی آن و یا مفهوم «مسئولیت» ذکر شده است. در پژوهش حاضر پس از اینکه موارد مربوط به حقوق مردم از متن کتاب «تنبیه الامه» استخراج گردید، به صورت منطقی و با توجه به رابطه حقوق با یکدیگر، دسته‌‌بندی شد. در این دسته بندی‌‌ها حقوق مختلف از یکدیگر به دقت تفکیک گردیدند. مهم‌‌ترین دسته‌‌بندی که حقوق را به صورت منطقی با یکدیگر مرتبط نموده است، تقسیم آن به حقوق کلان و خرده‌حقوق می‌‌باشد. بنابر همین تقسیم‌بندی، در مجموع 23 مورد از حقوق مردم در حکومت اسلامی بدست آمد، که 6 مورد از آن‌‌ها حقوق اصلی و کلان بوده و 17 مورد به صورت خرده‌حقوق، ذیل این حقوق کلان گردآوری و تنظیم شده‌‌اند. با این تقسیم‌‌بندی، علاوه‌بر تبیین روشن از منطق حاکم بر حقوق مختلف مردم از منظر نائینی، و ارتباط این حقوق با یکدیگر، کلی‌نگری مورد نیاز جهت پژوهش‌‌های هم‌افق و جستجوی حقوق لابه‌لای کلمات و عبارات کتاب «تنبیه الامّه» فراهم آمده و تسهیلی برای پژوهش‌‌های بعدی به ارمغان خواهد آمد.

the aim of the current research is to examine the formulation of people’s rights in an islamic government from the perspective of mirza nayini, relying on the book &tanbih al-ummah.& the research methodology is qualitative-inductive, beginning with a precise conceptualization of the terms &rights,& &people,& and &government& to establish a solid foundation for enhancing the depth and accuracy of the study. the analysis not only relies on explicit phrases used by mirza nayini but also incorporates his linguistic components. another achievement of this study is the comprehensive examination and clarification of terminologies and phrases employed by mirza nayini, resulting in a more precise categorization of rights, such as the exploration of the concept of &equality& and its extensive scope, or the notion of &responsibility.& following the extraction of relevant sections from &tanbih al-ummah,& these rights were logically categorized based on their interrelationships. this classification distinguished 23 cases of people’s rights in an islamic government, with 6 cases classified as fundamental and major rights, and 17 cases categorized as subsidiary rights, organized and regulated under these major rights. this categorization not only provides a clear elucidation of the governing logic behind various people’s rights from mirza nayini’s perspective but also facilitates a holistic overview necessary for concurrent studies and exploration of rights beyond the literal words and phrases of &tanbihal-ummah,& thereby facilitating future research.
