بررسی مفهوم عدالت در انتخابات از منظر فقه‌ سیاسی

هدف پژوهش حاضر بررسی مفهوم عدالت در انتخابات، از منظر فقه‌ سیاسی است. روش پژوهش توصیفی- تحلیلی بوده و نتایج نشان داد که به استناد احکام فقهی و قانونی، لزوم شرط عدالت برای انتخابات، بر دو رکن اصلی مطرح است: الف. کاندیداها و داوطلبان؛ ب. ناظران و مجریان (مجلس خبرگان، شورای ‌نگهبان و قوای مجریه و مقننه). مفهوم عدالت، در امین و امانت‌دار بودن ناظران و مجریان در حفظ آرای مردم است؛ که بیانگر عدالت ‌فعلی آنان در امانت‌داری است. کاربرد و تاثیر عدالت در احکام فقه‌ سیاسی انتخابات موجب خواهد شد، چالش‌ها و تنش‌هایی انتخاباتی را که قبل و پس از برگزاری انتخابات رخ می‌دهد، پیشگیری و رفع نمود. افزون بر آن، با انتخاب اصلح از نخبگان و کارشناسان در امور مختلف جامعه، منجر می‌شود، تاثیر آن- به معنای واقعی کلمه- در عدالت اقتصادی، حقوقی، سیاسی و به طور کلی در همه‌ زمینه‌ها بروز و ظهور داشته ‌باشد و جامعه‌ اسلامی را به سوی رشد و تعالی پیش برد. از سوی ‌دیگر، با حضور حداکثری مردم، مهر تاییدی بر نظام جمهوری‌ اسلامی باشد و به دنبال آن، امنیت و آرامش را به ارمغان آورد.

a study of the concept of justice in elections from the view of political jurisprudence

the purpose of the present research is to study the concept of justice in elections from the view of political jurisprudence. the research method is descriptive-analytic and the results showed that with reference to jurisprudential and legal rules, the perquisite of justice condition for elections relies on two main foundations: a. candidates and volunteers; b. supervisors and executers (assembly of experts for leadership, guardian council, executive and legislative forces). the concept of justice denotes the trusteeship of supervisors and executives to maintain people’s votes which conveys their current justice bailment. the application and effectiveness of justice in political jurisprudential rules of elections can prevent and remove challenges and tensions that would occur before or after election. moreover, by choosing the best elites and experts in different social issues, it would truly effect on economic, legal, political, and other aspects of justice to lead the society toward development and betterment. on the other hand, people’s maximum participation in elections would confirm the legitimacy of the islamic republic government and as a result, bring security and peace for the country.
