نهادهای بین‎المللی و ارتقاء حکمرانی در پرتو توسعه انسانی

هدف پژوهش حاضر پاسخ به این سوال اساسی است که نهادهای بین‎المللی چگونه و از طریق چه سازوکارهایی می‎توانند بر حکمرانی، به‌مثابه امری داخلی در کشورها تاثیرگذار باشند؟ روش پژوهش توصیفی- تحلیلی بوده و به نظر می‎رسد نهادهای بین‎المللی از طریق اعمال فشار و ارائه رویه‎های قانونی، وضعیت توسعه انسانی در کشورهای مختلف را تغییر می‎دهند، در نتیجه موجب ارتقاء سطح حکمرانی در کشورها می‎شوند. در این پژوهش آراء دیوان بین‌المللی دادگستری به عنوان نمونه موردی، بررسی شده و نتایج حاکی از این است که آراء دیوان، دولت‎ها را در برابر کل جامعه بین‎المللی نسبت به حقوق بنیادین بشر متعهد می‌‌سازد. شناسایی حق تعیین سرنوشت و حق صیانت ذات به‌مثابه یافته‌‌های گران‌بهاء، در آراء دیوان قابل توجه است. نقش دیوان در توسعه و تثبیت این قواعد نیز بی‌‌تردید یکی از بارزترین نمونه‎های حمایت دیوان از توسعه انسانی است. از منظر دیوان، اجرای این قواعد در زمان صلح بیش از زمان جنگ ضرورت دارد و همین منجر به ارتقاء سطح حکمرانی می‎شود.

international institutions and betterment of governance in the light of human development

the purpose of the present study is to answer this main question: how and by which means can international institutions be effective on national governance in the countries? the research method is descriptive-analytic and it seems that international institutions can change the condition of human development in countries by enforcement and representation of legal procedures so they can improve the condition of governance in those countries. in this research, the judgments of the international court of justice were reviewed as a case study and the results showed that the verdicts of the court make the governments committed to fundamental human rights in front of the whole international society. recognition of the right to self-determination of peoples and self-preservation as precious findings are considered important among the verdicts of the court. the role of the court in expanding and stabilizing these regulations is undoubtedly one of the most outstanding instances of its support from human development. from the perspective of the court, enforcement of these rules at the time of peace is even more essential than when there is war and this can lead to the betterment of governance.
