امنیت حقوق مالکیت و نسبت آن با الگوی اسلامی - ایرانی پیشرفت

هدف پژوهش حاضر بررسی وضعیت امنیت حقوق مالکیت در ایران بین سال‌های 1396-1304 بود. در این پژوهش از نظریه توازن دوگانه نورث، والیس و وینگاست استفاده شده‌ و متغیرهای حاکمیت قانون، کنترل فساد، بی‌طرفی دادگاه‌ها، استقلال دستگاه قضائی، چشم‌انداز سرمایه‌گذاری و دسترسی به وام و اعتبارات ارزیابی شد. روش مطالعه تحلیلی توصیفی، با استفاده از موازین نهادگرایی است. یافته‌ها حاکی از وضعیت نامطلوب متغیرهای یاد شده و ناامنی حقوق مالکیت بخش‌های مولد ‌است که موجب رشد بخش‌های نامولد، افزایش رانت‌جویی، رشد نامطلوب ابداع و کارآفرینی و نظام دسترسی محدود شده ‌است. برای تحقق الگوی اسلامی ایرانی پیشرفت ایجاد امنیت حقوق‌ مالکیت از طریق دسترسی باز و بهبود و توجه به متغیرهای بررسی شده در این پژوهش لازم و ضروری است.

Security of Property Rights and Its Relation to the Islamic-Iranian Model of Progress

The purpose of the present study is to review the security of property rights in Iran during 1304 to 1396. The theory of double balance proposed by North, Wallis, and Weingast is used in this research to review some variables including the rule of law, control of corruption, impartiality of courts, judicial independence, and access to loans and credits. The method of study is descriptive analysis using institutional economics. The results indicate the unfavorable condition of the abovementioned variables as well as the insecurity of property rights in production centers resulting in unproductivity, economic rent, unfavorable growth of creativity and entrepreneurship, and limited access system. The present study concludes that for the fulfillment of the IslamicIranian model of progress, it is essential to secure the rights of property throughout open access to resources and improving the abovementioned variables.
