الزامات اجتماعی- سیاسی پذیرش بیع صبی در امور یسیره؛ با تاکید بر دیدگاه فیض کاشانی

هدف پژوهش حاضر بررسی مسئله اهلیت طرفین در بیع با محوریت نظر فیض کاشانی مبنی بر جواز بیع صبی در اشیاء یسیره و موارد اختلاف آن با دیگر فقیهان است. در این راستا الزامات اجتماعی و سیاسی پذیرش بیع صبی در امور یسیره براساس دیدگاه فیض کاشانی بررسی شد. روش پژوهش توصیفی تحلیلی بوده و نتایج حاکی از آن است که پذیرش صحت بیع صبی منجر به بسط مفهوم مشارکت اجتماعی و سیاسی خواهد شد. با این توضیح که جواز بیع صبی در امور یسیره، جواز صحت حضور صبی در امور اجتماعی و سیاسیِ یسیره را نیز ایجاد می‌کند، به نحوی که می‌توان ملازمه میان این دو برقرار کرد. این ملازمه، پای صبی را در کنش‌های یسیره سیاسی و اجتماعی باز می‌کند و حضور او در فعالیت‌های جمعی مانند «شورا»، «انتخابات»  و «حق رای» و مانند آن برای اظهارنظر در خصوص امور یسیره را  وجه شرعی می‌بخشد.

The Social-Political Requirements of the Acceptance of Transaction with Children in Micro-level Issues with Emphasis on the Viewpoint of Feyz Kashani

The purpose of the present study is to explore the qualification of those who take part in a transaction with special emphasis on the ideas of Feyz Kashani on the admissibility of transaction with children in microlevel issues as well as the discrepancies between his ideas and other jurists’. In this regard, the social and political requirements of the admissibility of transaction with children in microlevel issues were studied based on the viewpoints of Feyz Kashani. The method of study was descriptive analysis and the results showed that accepting the validity of transaction with children would lead to the extension of the concept of political and social participation. The permissibility of transaction with children in microlevel issues implies the permissibility of their participation in microlevel social and political issues as well. There is a sort of correlation between the two abovementioned aspects which permits the participation of children in social and political microlevel activities and legitimizes their presence in some social activities such as “councils”, “elections”, “voting” and so on in order to give their ideas in microlevel issues.
