ظرفیت‌سنجی منابع فقه سیاسی شیعه در مباحث مکاسب محرمه

هدف پژوهش حاضر پاسخ به این پرسش بود که از موضوعات مکاسب محرمه به عنوان یکی از گسترده‌ترین موضوعات فقه، چگونه می‌توان در تبیین مبانی و منابع فقه سیاسی بهره جست؟ در این راستا، پژوهش حاضر با روش تحلیلی توصیفی به واکاوی ظرفیت‌‌هایی از فقه سیاسی موضوعات مکاسب محرمه پرداخته است. قواعد و مسائل فقه سیاسی و منابع اجتهاد در فقه سیاسی که با بررسی رویکرد فقها در استنباط موضوعات سیاسی در مباحث مکاسب محرمه قابل شناسایی است، عمده مباحث مورد بررسی در این پژوهش بودند. مهم‌ترین نتایج تحقیق، شناسایی ظرفیت موضوعات مکاسب محرمه در شناسایی منابع تکمیلی برای اجتهاد در فقه سیاسی است که می‌توان ضروت توجه به عقل، نظارت مقاصد شریعت و نیز توجه به مقتضیات زمان و مکان را به عنوان این منابع نام برد. بدین صورت که عقل می‌تواند نقش مهمی در تعیین حدود موضوعات احکام سیاسی و نیز تشخیص ملاک اهم در موقعیت تزاحم در فقه سیاسی داشته باشد. کارکرد مقاصد شریعت را نیز می‌توان در تفسیر نصوص در فرایند استنباط احکام شرعی و نیز شناخت ملاک اهم در موقعیت‌های تزاحم پس از استنباط مورد توجه قرار داد. در رویکردهای معاصر به فقه سیاسی مانند رویکرد امام خمینی، توجه به مقتضیات زمان و مکان نیز به عنوان منابع تکمیلی در اجتهاد و تشخیص مصلحت در مسائل فقه سیاسی مورد استفاده قرار گرفته ‌است.

A Potentiality Study into the References of Shi’ite Political Jurisprudencein Haram Businesses (Makasib-e Moharrameh)

The objective of this study is to answer how can we use the subjects in Haram Businesses (Makasebe Moharrameh) as one of the most extensive jurisprudential issues to explain the principles and references in political jurisprudence. In this regard and using descriptive analysis, the present study aims to delve into the potentiality of political jurisprudence in Makasebe Moharrameh. Principles and issues as well as Ijtihad refrences in the political jurisprudence recognized by the study of jurists’ approach in inferring the political issues in Makasee Moharrameh are among the most significant issues in this research. The most important results of this study denote identification of the potentials of in Makasebe Moharrameh in order to recognize complementary references for Ijtihad in political jurisprudence such as reason, purposes of shariat, and place and time requirements. Thus the faculty of reason can play an import role in determining the borders of political rules and the criterion for prioritization in overlapping situations in political jurisprudence. The function of religious purposes can also be consiodered in the exegesis of Qur’anic verses in the process of inferring religious rules and prioritization criterion in overlapping situations. In contemporary approaches to political jurisprudence like Imam Khumeini’s approach, time and place requirements as the complementary references in Ijtihad and expediency in political jurisprudential issues are also taken into account.
