امکان‌سنجی مهندسی فقه سیاسی در سه پارادایم «فقه حکم و موضوع»، «فقه نظام‌سازی» و «فقه تکامل اجتماعی»

فقه سیاسی شیعه در ادوار مختلفی از حیات خود، تحولاتی را از سر گذرانده است؛ وقوع انقلاب اسلامی، یکی از این نقاط تحول است که دامنه و عمق تحولات این علم در این بزنگاه تاریخی بسیار شگرف به‌نظر می‌رسد. سوال اصلی این است که آیا تحولات دانشی فقه سیاسی، مهندسی پذیر است یا نه؟ در این مقاله با بررسی و نقد دو رویکرد فقه حکم و موضوع و فقه نظام سازی به‌عنوان دو رویکرد رایج، ویژگی‌ها و مولفه‌های رویکرد فقه تکامل اجتماعی را بررسی خواهیم کرد. مدعا این است که رویکرد فقه تکامل اجتماعی، با توجه به مطلوبیت‌های مورد نظر شارع و جهت گیری‌های نظام اسلامی و حکومت دینی، از قابلیت‌های بیش‌تری برای مهندسی فقه سیاسی برخوردار است

Feasibility study of Political jurisprudence engineering in the three paradigms of Jurisprudence of Subject and verdict, Jurisprudence of Systematization and Jurisprudence of Social Evolution

The Shiite political jurisprudence has undergone a number of developments during different periods of its life; the occurrence of the Islamic Revolution is one of the points of change that make the scope and depth of the developments of this science very remarkable at this historical juncture. The key question is whether knowledge developments of political jurisprudence are capable of being engineered? In this article, we will examine the features and components of the jurisprudence approach by examining and critiquing the two approaches of jurisprudence and subject matter and systematic jurisprudence as two common approaches. It is argued that the social evolution jurisprudence approach has more potential for the engineering of political jurisprudence, given the desirability of the jurisprudence and Islamic and governmental system orientations.
