تعالی رهیافت نظام سیاسی حقوقی اسلام در رفع تعارض قوانین

هدف پژوهش حاضر تبیین رهیافت نظام  سیاسی حقوقی اسلام در رفع تعارض قوانین بود. در این راستا و با روش توصیفیتحلیلی، قدرت سیاسی در ایدئولوژی‏های حکومت، پیشینه‏ی قدرت سیاسی و نسبت آن با مبانی حقوقی، اهمیت بحث تعارض قوانین در پایداری قدرت نرم، تعارض قوانین و نسبت‌سنجی گزاره‌ها، روش فطری اصول فقه در رفع تعارض، استدلال بر رفع تعارض قوانین، تطبیق روش فطری اصول فقه و استنتاج نظام رفع تعارض قوانین مورد بحث قرار گرفته‌اند. یافته‌ها نشان داد، شالوده‌‎ی رژیم رفع تعارض قوانین با روش اصول فقه چه بر منطق دینی و چه از دیدگاه امانیستی به جهت تکیه بر فطریات بشری در فهم کلام و متن، مولفه‎ای بارز از قدرت نرم نظام سیاسی حقوقی اسلام و پاسخگوی خلاء نظام حکیمانه، مدون و مقبول رفع تعارض قوانین در حیطه‌ی داخلی و بین‌الملل است.

The achievements of Islamic legal political system approach in eliminating conflicts of laws

This project was aimed at demonstrating the role of Islamic legal political system approach in eliminating conflicts of laws. With this regard a descriptive analytical method has been employed to debate a series of contributing factors including political power in government’s ideology, origins of political power and its association to legal basis, the significance of conflicts of laws to stability of soft power, laws conflict and the ratio of proposals, the guardianship of the Islamic jurist approach in solving conflict of laws, reasoning behind solving conflict of laws, and adapting jurisprudence approach for solving conflicts. The results indicate that basis of remedies for conflict of laws with respect to guardianship of the Islamic jurist principle either to religion logic, or from humanistic viewpoint equals the major factor. This is because of its reliance on human nature, so that it can compensate the absence of an international or a domestic written acceptable wise solution for the conflict of laws.
