اصول حاکم بر نبردها در مخاصمات مسلحانه از دیدگاه نهج‌البلاغه

حقوق مخاصمات مسلحانه به‌عنوان یکی از شاخه‌های حقوق بین‌الملل، شامل مجموعه قواعد و مقرراتی است که هدف آن حمایت از افراد نظامی و غیرنظامی در درگیری‌های مسلحانه و همچنین ایجاد محدودیت در انتخاب و استفاده از برخی از ابزارها و شیوه‌های جنگی برای طرف‌های متخاصم است. این حمایت از انسان‌ها در زمان کارزار و ایجاد محدودیت در کاربرد برخی وسایل و روش‌های جنگی موضوعی است که ریشه‌ای عمیق در مکتب اسلام دارد و امیرالمومنین امام علی(ع) در زمان نبرد با دشمن بر رعایت آن تاکید فراوان داشته‌اند. پژوهش حاضر به شیوه توصیفی- تحلیلی و با هدف تبیین اصول حاکم بر نبردها در مخاصمات مسلحانه از دیدگاه امیرالمومنین امام علی(ع) با تاکید بر کتاب شریف نهج‌البلاغه، به این پرسش اصلی پاسخ خواهد داد که اصول حاکم بر نبردها در مخاصمات مسلحانه از دیدگاه امیرالمومنین امام علی(ع) با تاکید بر کتاب شریف نهج‌البلاغه شامل چه مواردی می‌شود؟ نتیجه کلی به‌دست‌آمده از این پژوهش دلالت بر آن دارد که اصل تفکیک بین افراد نظامی و غیرنظامی، اصل رفتار انسانی، اصل حمایت از افراد غیرنظامی، اصل ممنوعیت برخی از ابزارهای جنگی، اصل منع ایجاد گرسنگی و تشنگی، اصل رفق و مدارا با اسیر جنگی و اصل حمایت از محیط‌زیست از جمله اصول حاکم بر مخاصمات مسلحانه از دیدگاه امیرالمومنین امام علی(ع) است تا از هر نوع عمل غیرانسانی و انتقام‌گیری در جنگ جلوگیری شده و آلام و درد و رنج بشری ناشی از آن کاهش یافته و یا پیشگیری گردد.

the principles governing battles in armed conflicts from the perspective of nahj al-balagha

the law of armed conflict is one of the branches of international law. its purpose is to support military and civilian people in armed conflicts and also to limit the choice and use of some war tools and methods for the warring parties. this support for human beings and creating limitations for the use of some warring methods and tools is deeply rooted in islam, and has been emphasized by the leader of muslims, imam ali. the present research was done in a descriptive-analytical way. the purpose of this study is to explain the principles governing battles in armed conflicts from imam ali’s point of view. this research will answer the main question, ‘what are the principles governing battles in armed conflicts from imam ali’s point of view, emphasizing the noble book of nahj al-balagha?’ the overall result obtained from this research indicates that in order to prevent any kind of inhuman act in war and reduce human suffering, the principle of distinction between military and civilian people, the principle of human behavior, the principle of protecting civilians, the principle of prohibiting some weapons of war, the principle of preventing hunger and thirst, the principle of friendship and tolerance with prisoners of war, and the principle of protecting the environment are among the principles governing armed conflicts from the point of view of imam ali.
