حقوق اشخاص دارای معلولیت در قانون حمایت از معلولان 1396 با رویکردی بر نامه امام علی (ع) به مالک اشتر

افراد دارای معلولیت به عنوان قشر عظیمی از جمعیت جهان برای بهبود شرایط زندگی‌شان، نیازمند اعمال تبعیض‌های مثبت می‌باشند. ازاین‌رو جهت تضمین بهره‌مندی این افراد از حقوق و آزادی‌های اساسی، سال 1396 قانون حمایت از حقوق معلولان به تصویب مجلس شورای اسلامی رسید. در این پژوهش با نگاهی به نامه امام علی (ع) به مالک اشتر نحوه حمایت حقوقی حاکم اسلامی را از این قشر آسیب‌پذیر جامعه با قانون حمایت از معلولان در ایران مورد بررسی قرار می‌دهیم.     مقاله حاضر به روش توصیفی تحلیلی و با استفاده از داده‌های کتابخانه‌ای مفاهیم موجود در متن نامه امام علی (ع) که ناظر بر مفهوم افراد دارای معلولیت و توانخواه در گذشته بوده را مورد مطالعه قرار داده و سپس به عنوان الگویی برای جوامع و حکومت‌های اسلامی مهمترین اصول اندیشه‌های حقوقی امام را در ارتباط با افراد دارای معلولیت در سه اصل: 1. الزام آوربودن رعایت حقوق افراد دارای معلولیت، 2. فراگیری حقوق نسبت ایشان و 3. حفظ کرامت انسانی مورد بررسی قرار داده است.     نتایج حاکی از آن است که عناوین موجود در متن نامه را حتی اگر نتوانیم از لحاظ مفهومی توسعه داده و بر معلولان منطبق سازیم ولی از جهت مصداقی هیچ شکی وجود ندارد که عناوین این گروه نیازمند را در برگرفته و لذا احکام بیان شده توسط امام شامل این قشر آسیب‌پذیر جامعه می‌گردد. رعایت اصول فوق، نویدبخش یک جامعه اسلامی است؛ که در آن حقوق افراد مطابق با کرامت ذاتی آن ها تامین گردیده و همه مردم در برابر قانون یکسان تلقی می‌شوند.

The rights of persons with disabilities in the Law on the Protection of the Disabled 1396 with an approach to Letter of Imam Ali (AS) to Malik Ashtar

People with disabilities, as a large segment of the world’s population, need positive discrimination to improve their living conditions. Therefore, in order to guarantee the enjoyment of these people of their fundamental rights and freedoms, in 1396, the Law on the Protection of the Rights of the Disabled was approved by the Islamic Consultative Assembly. In this study, looking at the letter of Imam Ali (AS) to Malik Ashtar, we examine the manner of legal protection of the Islamic ruler from this vulnerable segment of society with the law for the protection of the disabled in Iran. he present article uses a descriptiveanalytical method and using the library data of the concepts in the text of Imam Ali’s (AS) letter, which looks at the concept of people with disabilities in the past, and then as a model for Islamic societies and governments. The most important principles of Imam’s legal thoughts in relation to people with disabilities in three principles: 1. Mandatory observance of the rights of people with disabilities, 2. Learning the rights of their relatives 3. Preservation of human dignity has been examined. The results indicate that even if we can not conceptually develop the titles in the text of the letter and adapt them to the disabled, but there is no doubt that the titles of this group include the needy and therefore the rulings expressed by the Imam include this It becomes the vulnerable stratum of society. Observance of the above principles is promising for an Islamic society; In which the rights of individuals are guaranteed in accordance with their inherent dignity and all people are treated as equal before the law
