خوانش حقوق عمومیِ «حاکمیت» در آموزه‌های نهج‌البلاغه

«حاکمیت» از مفاهیم بنیادی در حقوق عمومی بوده که بدون درک آن، نمی توان درک صحیحی از دولت مدرن داشت. نوشتارِ حاضر این موضوع را در نهج البلاغه به بحث گذاشته و به این سوال پاسخ داده است: از دیدگاه حقوق عمومی، مفهوم حاکمیت در آموزه هایِ نهج البلاغه چیست؟ در پاسخ به این سوال، با استفاده از روش توصیفیتحلیلی، تلاش شده در آغاز، مستنداتی از نهج البلاغه، پیرامونِ سوال تحقیق ذکر شود. سپس پیامدهایِ حقوقِ عمومیِ موضوع، بررسی شود. حاصل تحقیق آن است که اولاً؛ در نهج البلاغه، سه گونه برداشت از «حاکمیت» مطرح است. ثانیاً؛ گونۀ نخستِ حاکمیت که البته از جنس «خالقیت» است، مختص ذات اقدس حضرت باری‌تعالی است. ثالثاً؛ سطح دوم در آموزه های نهج البلاغه، حاکمیت به آن معنایی که در دنیای مدرن مطرح است ذکر نشده بلکه عمدتاً این واژه با معانی فرمانروا، حاکم، سلطنت و زمامدار ذکر شده است. به این اعتبار، در دنیای قدیم، حاکمیت به‌مثابۀ تاسیس حقوقیِ خودآیین و مستقل مطرح نشده بلکه دربردارندۀ مفهومی از مفاهیم حوزۀ عمومی است که در خدمت سایر غایات درمی آید. در اثرِ چنین وابستگی، «حاکمیت» با «حکومت کردن» دچار مرزهای شکنندۀ معنایی و کارکردی می شود. رابعاً؛ سطح سومِ حاکمیت که از جنس «سیاسی» است؛ مختص مردم است و البته هیچ‌گونه حلقۀ رابطی بین مردم و خدا در نظر ندارد بلکه پیونددهندۀ این رابطه، برداشتِ درونی انسان‌ها است و این برداشت، نزدیک‌ترین معنا به مفهومِ مدرنِ حاکمیت است. خامساً؛ برداشت اخیر از حاکمیت، دربردارندۀ پیام‌های مهمی برای حقوق عمومی مدرن است.

Reading the Public Law of "Sovereignty" in the Teachings of Nahj al-Balaghah

“Sovereignty” has been one of the fundamental concepts in public law that Without understanding it, one cannot have a correct understanding of the modern state. The present article discusses this issue in Nahj alBalaghah and it has answered to the quastion: from the perspective of public law, what is the concept of sovereignty in the teachings of Nahj alBalaghah? In answer to the question, using the research method: analytical descriptive, it has been tried first, to be told a documentary of Nahj alBalaghah about the question. Then, it has reviewed the consequences of the public law. The research results are that first; In Nahj alBalaghah, there are three types of perceptions of &sovereignty.& Second; first kind of sovereignty that is the type of “crative”; that is particular of God. Third; second level in teachings of Nahj alBalaghah, the concept of sovereignty has not mentioned to the meaning of modern age in rather than, the word basically, has mentioned with governor, sovereign, kingdom and ruler. Thus, in ancient world, the sovereignty has not mentioned as a legal institution of autonomous and independent, but it is incorporate the concept of public law conceptions that is to the other of goals. according such of dependence, “sovereignty” with “to govern” has fragil boundary of meaning and fanctional. Fourth; The third level of sovereignty is the type of “political”; is particular of people and there is no relating ring between people and God, but the joining relationship is the internal conception of the Moslems, and this perception is closest to the modern concept of sovereignty. Fifth; The recent conception of sovereignty has important implications for modern public law.
