نگرشی به شکل‌گیری حکومت حضرت علی(ع) از منظر حقوق عمومی

«حکومت» ازجمله مفاهیم پرتنش و پربحث در حیطه های مختلف علوم انسانی، نظیر حقوق عمومی، است. به نظر می رسد بررسی نظریه ها و آرای بزرگان تا حدودی بتواند از چالش های نظری پیرامون این موضوع بکاهد. در میان شیعیان، حضرت علی(ع)، اسوۀ کمال از هر حیث به‌شمار می آید و سیرۀ نظری و عملی آن حضرت از زوایای گوناگون برای زندگی امروزیِ ما پندآموز است. بنابراین در این نوشتار، درصددیم تا شکل گیری حکومت آن حضرت را از منظر حقوق عمومی به بحث  و واکاوی بگذاریم. سوال اصلی این است: پیامدهای شکل گیری حکومت در سیرۀ امام علی(ع) از منظر حقوق عمومی چیست؟ در پاسخ به این سوال، با استفاده از روش توصیفی تحلیلی، تلاش شده نخست به ذکر مستنداتی از سیرۀ آن حضرت، پیرامونِ شکل گیری حکومتش پرداخته شود. سپس پیامدهای حقوق عمومی چنین شیوه ای از تشکیل حکومت بررسی شود. حاصل تحقیق آن است که شیوۀ شکل گیریِ حکومت حضرت علی(ع) در جامعۀ اسلامی بی نظیر بود و سیرۀ آن حضرت دربردارندۀ اصول و مفاهیمِ حقوق عمومی، به ویژه مردمی بودن نظام سیاسی، عقلانی بودن حکومت، غیرقدسی بودن حکومت، امانی بودن مسند حکومت و حق حاکمیت مردم بوده است.

An Attitude to Formation of Imam Ali’s Government from the Perspective of Public Law

“Government" is one of the most tension and controversial concepts in various fields of human sciences like public law. It seems to be the study of theories and opinions of the elders to some extent, it can reduce the theoretical challenges surrounding this issue. Among the Shiites, Imam Ali (as) is considered as the perfection of all kinds and theoretical and practical way of his Imam is tutor from various angles to our present life. So in this article, Using the research method: analytical descriptive, has been tried first, to be told a documentary about the course of the Imam, about the formation of his government. Then, it has reviewed the consequences of the public law of such a mode of government formation. The research results are that the way of forming the government of Imam Ali was unimaginable in Islamic society and his methodology have been based on the principles and concepts of public law, in particular: the popularity of the political system, the rationality of the government, nonsanctity of government, being deposit the government and people’s sovereignty.
