بررسی فقهی جبران کاهش ارزش پول (با رویکرد مبنایی تحلیل ماهیت پول)

بحث تورم، کاهش ارزش پول و چگونگی جبران آن، جزء بحث‌های روز محافل علمی، فقهی و اقتصادی است. اقتصاددان‌ها در پی مهار آن و فقها به دنبال تبیین احکام فقهی مترتب بر این پدیده هستند. بهترین روش برای تعیین تکلیف احکام فقهی پول و مسائل آن در اقتصاد اسلامی برخورد مبنائی با آن است. از آن طرف شرط لازم برای حل مبنایی‌ این احکام و مسائل ارائه تحلیل دقیق از ماهیت پول است. این پژوهش با روش توصیفی تحلیلی با مشکل دانستن نتایج فقهی دو نظریه مبنایی «مالیت اعتباری» و نظریه «ارزش اسمی»، نظریه مبنایی سومی تحت عنوان نظریه «مال اعتباری» ارائه کرده است. بر اساس این تحلیل کاهش ارزشی که ناشی از عملکرد سیاست پولی انبساطی بی‌رویه دولت باشد محصول نقض اعتبار و نقص در مال بوده و مشمول قاعده‌های فقهی‌ اوفوا بالعقود، اتلاف و دیگر قاعده‌های فقهی است. بر این اساس دولت ضامن بوده و به دلایل متقن مسئول و موظف است حقوق‌ها و دستمزدها را بی‌منّت ترمیم و جبران کند و با توجه به این‌که این ضرر و تلف در بلندمدت در بطن افزایش اسمی درآمدها، حقوق‌ها و دستمزدها جبران و برطرف شده و در کوتاه‌مدت این ترمیم صورت نمی‌گیرد، حکم فقهی جبران کاهش ارزش پول برای بدهی‌های بلندمدت و کوتاه‌مدت بین مردم متفاوت است.
