چارچوب خط مشی مالکیت فکری در پروژه های تحقیق و توسعه مشارکتی

گسترش مشارکت‌های پژوهشی میان صنعت، دولت و دانشگاه، به دلیل وجود مشارکت‌کنندگانی با ماهیت، منافع و انگیزه‌های متنوع، موجب بروز چالش‌هایی در حوزه مالکیت‌‌فکری شده‌است. بویژه زمانی که از منابع مالی دولتی استفاده شود، وجود چارچوبی برای خط‌مشی مالکیت‌فکری از اهمیت مضاعفی برخوردار می‌شود. در این تحقیق تلاش شده‌است با استفاده از روش نظریه داده‌بنیاد با رویکرد ظاهرشونده، چارچوبی برای خط‌مشی مالکیت‌فکری در پروژه‌های تحقیق و توسعه مشارکتی، ارائه شود. برای این منظور، به بررسی منابع علمی مرتبط و مصاحبه با خبرگان دارای دانش و تجربه کافی، تا حصول اشباع نظری پرداخته و چارچوب مورد نظر استخراج شد. چارچوب ارائه‌شده دارای چهار بعد اصلی &عوامل زمینه‌ای&، &اهداف و پیامدهای مورد انتظار&، &فرآیند& و &محتوای خط‌مشی& ،13 مولفه و 42 جزء است. بر اساس نتایج حاصل‌شده، برای اتخاذ خط‌مشی مناسب دارایی‌های فکری پژوهش‌های مشارکتی، باید ویژگی‌‌ها و شرایط پروژه و ذینفعان آن به عنوان عوامل زمینه‌ای و پیامدهای مورد انتظار در کوتاه‌مدت، میان‌مدت و بلندمدت، مورد بررسی دقیق قرارگیرند. با توجه به ویژگی‌ها و ماهیت پروژه و ذینفعان آن، پیامدهای متفاوتی از خط‌مشی مالکیت‌فکری انتظار می‌رود. همچنین تدوین، اجرا و ارزیابی این خط‌مشی، تحت تاثیر عوامل زمینه‌ای و پیامدهای مورد انتظار آن قرار داشته و می‌توانند بر محتوای خط‌مشی نیز تاثیر بگذارند.

Intellectual Property Policy Framework in Cooperative Research and Development Projects

The expansion of research partnerships between industry, government and university has resulted in some challenges about intellectual property due to different participants with diverse natures, interests and motivations. Especially in the case of publicly funded projects, existence of a framework for intellectual property policy becomes doubly important. In this research, we attempt to design a framework for intellectual property policy in such projects using grounded theory method. For this purpose, we reviewed related scientific sources and conducted interviews with experts with relevant knowledge and experience to obtain theoretical saturation. The proposed framework has four main dimensions: &contextual factors&, &objectives and expected outcomes&, &policy process& and &policy content&, 13 factors and 42 components. Based on the results, to adopt an appropriate intellectual property policy for collaborative research, the characteristics and conditions of the project and its stakeholders as contextual factors and the expected consequences in the short, medium and long term, should be considered. Depending on the characteristics and nature of the project and its stakeholders, different consequences are expected from the policy. Also, the development, implementation and evaluation of this policy are affected by contextual factors and its expected consequences and can affect the content of the policy.
