بررسی قوانین و اصول حاکم بر حمایت از سرمایه گذاری خارجی در ایران، کانادا و ترکیه

با توجه به اهمیت فوق العاده مباحث و مسائل حقو قی مرتبط با حما یت از سرما یه گذرا نخار جی، ا ز جمله راهکارهایی که با یست به طور جدی درا ین زمینه مدنظر قرار داد؛ توجه به موضوع امنیت قانو نی سرما یه گذرا ن است. از ا ین رو در ا ین مقاله تلاش شده تا قوانین و اصول حاکم بر حمایت از سرما یه گذا ری خارجی در ا یران ، کانادا و تر کیهتحلیل قرار گیرد. درا ین مقاله که به روش تو صیفی - تحلیلی و با بهره گیری از منابع ومتون کتابخانه ا ی به انجام رسیده ا ین نتا بج حاصل گردید که امنیت قانو نی در دو کشورمورد تطبیق یعنی ترکیه و کانا د ا ز ضریب بسیا ر خو بی برخوردار بوده و از مهمترین عوامل موفقیت آنها در جذب و بهره مندی از سرما یه گذا ری های اثربخش خارجی بوده است. به معنای وجود قوا نین و مقررات صریح و مناسبی است که دارا ی دو ویژگی باشند اولا قوانین و مقررات مزبور بایستی ثبات داشته و ثانیا توسط افرای و نهادها رعایت شوند علاوه بر کانادا و تر کیه ا ین موضوع در ا یرا ن نیز با توجه به سابقه تقنینی در ز مینه حمایت از سرمایه گذاری خارجی نسبتا مطلوب ارزیابی می شود رعایت اصول و استانداردهای بین المللی رفتار با سرمایه گذاران خارجی علیرغم برخی مشکلات نظیر عدم ذکر اصول در قوانین موضوعه در ایران و شیوه های اجرا و اختلاف نظر در نحوه رسیدگی به اختلاف در مجموع در کشورهای هدف پژوهش محقق بوده و قابلیت اجرا دارند.

given the extreme importance of legal issues and discussions related to the protection of foreign investors, among the solutions that should be seriously considered in this regard is the issue of legal security of investors. therefore, this article attempts to criticize and analyze the laws and principles governing the protection of foreign investment in iran, canada, and turkey. in this article, which was conducted using a descriptive-analytical method and using library resources and texts, the following results were obtained: legal security in the two countries under consideration, namely turkey and canada, has a very good coefficient and has been one of the most important factors in their success in attracting and benefiting from effective foreign investments. legal security means the existence of explicit and appropriate laws and regulations that have two characteristics. first, the aforementioned laws and regulations must be stable and second, they must be observed by individuals and institutions. in addition to canada and turkey, this issue is also evaluated as relatively favorable in iran, given the legislative history in the field of protecting foreign investment. despite some problems, such as the lack of mention of the principles in the laws enacted in iran and the methods of implementation and disagreements in the way of handling disputes, the observance of international principles and standards for dealing with foreign investors has been achieved and is enforceable in the target countries of the study.
