مسئولیت دولت ها در قبال تروریسم و دزدی دریایی؛تحولات جدید حقوق بین الملل و حاکمیت سرزمینی

از زمان به وجود آمدن صنایع دریانوردی، همواره دریاها از اهمیت بالایی برخورداربوده است. همواره کشورها و دولت هایی که در مجاورت دریاها حضور داشته اند ویا در حوزه صنایع دریایی از توانایی های بالایی برخوردار بوده اند، توانسته اند ازقدرت تاثیر گذاری بالاتری در صحنه معادلات جهانی ایفا کنند. در این میان موضوع دزدی دریایی از دیرباز از موضوعاتی بوده که همواره صنعت کشتیرانی و امنیت خطوط مواصلاتی دریایی را تحت تاثیر قرار داده است.در طی‌ قرن های متمادی، موضوع دزدی دریایی‌ به‌ اشکال متعدد مطرح بوده است‌. ورود به‌ عصر جهانی‌ شدن و حضور ناوگان های عظیم‌ دریایی‌، همچنان شاهد نقش‌ افرینی‌ دزدان دریایی‌ به‌ عنوان برهم‌ زنندگان نظم‌ بین‌ المللی‌ بوده ایم‌. در خصوص برخورد با این‌ موضوع در طی‌ قرن بیستم‌ قوانین‌ متعددی در قالب‌ کنوانسیون های بین‌ المللی‌ مورد تصویب‌ کشورها و سازمانهای بین‌ المللی‌ قرار گرفته‌ است‌. از آنجایی که‌ مسئله‌ یاد شده با مسائل‌ متعددی از قبیل‌ بیمه‌ محموله‌ های دریایی‌ در ارتباط نزدیکی‌ قرار دارد و اقدامات دزدان دریایی‌ به‌ طور خاص در قضیه‌ سومالی‌ و سواحل‌ خلیج‌ عدن با امنیت‌ انسانی‌ گره خورده است‌، لزوم توجه‌ بیش‌ از بیش‌ جوامع‌ بین‌ المللی‌ به‌ این‌ موضوع احساس می شود. در تحقیق‌ پیش‌ رو تلاش خواهد شد تا با بررسی‌ ابعاد مختلف‌ موضوع یاد شده، جدیدترین‌ تحولات حادث شده در موضوع یاد شده مورد توجه‌ ویژه قرار گیرد

seas have always been of great importance since the advent of maritime industries. countries and governments that have been present in the vicinity of the seas or have had high capabilities in the field of maritime industries have always been able to exert a higher influence on the scene of global equations. meanwhile, the issue of piracy has long been one of the issues that has always affected the shipping industry and the security of sea lines. during many centuries, the issue of piracy has been raised in many forms. despite entering the era of globalization and the presence of huge sea fleets, we have still witnessed the role of pirates as disruptors of international order. regarding dealing with this issue during the 20th century, several laws have been approved by countries and international organizations in the form of international conventions. since the mentioned issue is closely related to many issues such as marine cargo insurance, and the actions of pirates, especially in the case of somalia and the coast of the gulf of aden, are tied to human security, the international community needs to pay more attention to this issue. will be in the upcoming research, an effort will be made to pay special attention to the latest developments in the mentioned subject by examining the various dimensions of the mentioned subject.
