بررسی سیاست‌های تخلفات صنفی در پرتو فضای سایبری در جمهوری اسلامی ایران

گستره وسیع فضای مجازی و رونق روزافزون کسب‌وکارهای دایر در این فضا از یک‌سو و توسعه‌یافتگی و گرایش جوامع به شیوه‌های نوین تامین کالا به منظور پرهیز از اتلاف وقت و انرژی و هزینه‌ها از سوی دیگر منجر به افزایش چشمگیر استفاده از تسهیلات الکترونیکی برای رفع احتیاجات و نیازهای اشخاص گردیده و اخیراً شیوع بیماری کرونا و ویروس کووید 19 نیز مزید بر علت شده است. به‌تبع افزایش کسب‌وکارهای مجازی شاهد افزایش تخلفات صنفی کسب‌وکارهای دایر در این فضا بوده و در نتیجه مطالبه گری مردم و مسئولین نیز به ویژه در این برهه حساس، فزونی یافته است. مبارزه با تخلفات صنفی در فضای مجازی، موضوعی است که در سال‌های اخیر به دلیل توسعه‌ی فضای تجارت الکترونیکی مورد توجه قانون‌گذار قرار گرفته است. روش گردآوری اطلاعات در این تحقیق روش کتابخانه‌ای است که به شکل متن‌خوانی و فیش‌برداری از داده‌های اصیل و دست اولی چون کتب علمی و مقالات علمی-پژوهشی فراهم شده است. نتایج تحقیق نشان می‌دهد که اگرچه قانون‌گذار در قانون اصلاح قانون نظام صنفی نگاه ویژه‌ای به این قبیل فعالیت‌ها کرده است. اما با توجه به گستردگی این فضا در تمامی ابعاد، با کم‌وکاستی‌های فراوانی روبرو هستیم که نیازمند اصلاح مقررات در این زمینه هستیم.

the vast expanse of virtual space and the growing prosperity of businesses operating in this space, on the one hand, and the development and tendency of societies towards new ways of supplying goods in order to avoid wasting time, energy and costs, on the other hand, lead to a significant increase in the use of electronic facilities to meet needs and requirements. people and recently the spread of corona disease and covid 19 virus has also become the cause. due to the increase of virtual businesses, there has been an increase in trade union violations of businesses operating in this space, and as a result, the demands of people and officials have also increased, especially in this critical period. the fight against trade union violations in the cyber space is an issue that has received the attention of the legislator in recent years due to the development of the e-commerce space. the method of collecting information in this research is the library method, which is provided in the form of text reading and scanning of original and first-hand data such as scientific books and scientific-research articles. the results of the research show that although the legislator has taken a special look at such activities in the law amending the trade union system law. but due to the vastness of this space in all dimensions, we are facing many shortcomings that we need to amend the regulations in this field.
