   قانونمندی: بنیاد پوزیتیویستی تاسیسات کیفری حقوق بین‌الملل

چکیده    پوزیتیویسم حقوقی که رکن رکین شکل‌گیری و قوام بسیاری از تعهدات و تاسیسات حقوقی بین‌المللی شناخته می‌شود، گاهی مترادف با فورمالیسم حقوقی تلقی شده و به مولفه‌ای تقلیل می‌یابد که منحصراً به منظور قالب‌بندی هنجارهای حقوقی به کار می‌رود. با این حال، پوزیتیویسم، نه تنها در شکل‌گیری صورت هنجارها، که عاملی بنیادین در تبلور ماهیت و جوهر تعهدات محسوب می‌شود. از این حیث، تحلیل بنیادهای فلسفی پدیده‌های حقوقی بین‌المللی در استیلای حقوقدانان طبیعی ارزش‌مدار نبوده و قانونمندی قواعد و نهادهای حقوقی که علاوه جنبه‌های شکلی، به جوهر و سرشت پدیده‌ها نیز نظر دارد، مدخلی را فراهم آورده تا پوزیتیویسم، به انگاره‌ای غایت‌مدار بدل شود. شناخت قواعد و هنجارهای کیفری حقوق بین‌الملل نیز از این امر مستثنا نیست. از این حیث، همزمان که جرم‌انگاری جنایات بین‌المللی در چارچوب حقوق بین‌الملل کیفری، نشان از رسوخ اندیشه‌های حقوق طبیعی در جوهر حقوق بین‌المللی کیفری دارد، قانونمندی قواعد و تاسیسات این حوزه می‌تواند مبین پدیداری خاستگاهای پوزیتیویسم حقوقی در این قلمرو محسوب شود.

   Legality: Positivistic Foundation of the Penal Institutions in International Law

Abstract    Positivism is distinct from natural law theories in that it holds that there is no necessary conceptual connection between law and morality, but Positivism sometimes has been diminished into pure formalism. While Formal procedures of formation of the rules and institutions in international law could be considered as a formalistic aspect of positivism, positivism may also enter into foundational frameworks in which the norms and the procedures could be formed. In this context the positivistic aspect of creation of legal institutions in international criminal law could be considered as an important element in evaluation of the legality of institutions. The principle of nonretroactivity of obligations, doctrine of act of State and the superior order are some of the relevant examples. In this article by focusing on the legal foundations for formation of the criminal institutions in international law, we will consider whether the Nuremberg was a legal criminal institution in international criminal law and how it is possible to generalize the criteria of legality to other international criminal institutions.
