الزامات و سازوکارهای پلیس اطفال و نوجوانان در ایران

پلیس ویژه کودکان و نوجوانان به عنوان یکی از نهادهای اختصاصیِ نظام دادرسی اطفال، در ایران برای نخستین بار در لایحه رسیدگی به جرایم اطفال و نوجوانان (1383) پیش‌بینی و پس از آن به صورت ضمنی در قانون برنامه پنج‌ساله پنجم توسعه، مورد تاکید قرار گرفت. وانگهی به دلیل عدم تصویب لایحه و همچنین اجرایی نشدن قانون برنامه توسعه، قانونگذار در قانون آیین دادرسی کیفری 1392 و در ماده 31 قانون آیین دادرسی کیفری ایجاد پلیس مخصوص اطفال و نوجوانان را پیش‌بینی و سازمان پلیس را مکلف به تشکیل آن نمود. اگرچه تشکیل پلیس ویژه می‌تواند در بهبود عملکرد سازمان پلیس و نظام عدالت کیفری در رابطه با اطفال و نوجوانان موثر باشد. نتایج حاصل از پژوهش حاضر نشان می‌دهد که تاسیس پلیس ویژه اطفال و نوجوانان بدون لحاظ الزامات خاص این گروه سنی و همچنین عدم بهره‌گیری از سازوکارهای ویژه و اختصاصی موثر نبوده در نهایت موجب فربهی و کاهش چالاکی بیشتر سازمان پلیس خواهد شد. بررسی تطبیقی موضوع در کشورهای مختلف و به ویژه امریکا نشان می‌دهد که لازمه کارآمدی و بهره‌وری پلیس اطفال و نوجوانان تغییر ساختار سازمانی، ایجاد نظام آموزشی نظام‌مند، پیش‌بینی سازوکارهای رفتاری و ارتباطی موثر، به کار‌گیری فرآیند انجام مصاحبه ویژه، پیش‌بینی ضمانت اجراهای قابل اجرا توسط پلیس و اتخاذ سازوکارهای پیشگیری پلیسی است. بر این اساس، باتوجه به نوظهور بودن آن در نظام عدالت کیفری ایران پژوهش حاضر بر آن است ضمن مطالعه اجمالی سیر تحولات تقنینی در رابطه با پلیس اطفال و نوجوانان در عرصه بین‌المللی و همچنین نظام حقوقی ایران و امریکا، به صورت مشخص الزامات و سازوکارهای تشکیل پلیس کودکان و نوجوانان در ایران را شناسایی و با استفاده از تجربه سایر کشورها در این زمینه راهکارهای اجرایی و عملی با هدف تشکیل مناسب، اثربخش و کارآمد پلیس اطفال و نوجوانان ارائه نماید.

Juvenile police is a One of the specific institutions In relation to juvenile justice system. Although with the use of juvenile Officer the police can improve the performance of the it’s Organization and the criminal justice system in relation to children and young people. But the results of this study show that Formation of the Police without regard to the specific requirements of this age group and without the use of special mechanisms is not effective and eventually causing the obesity and reduce the Performance of police organization. A comparative study in various countries, especially in America shows juvenile police Requires the Changing in the organizational structure, Create the Systematic educational system, Forecast the Communicational and behavioral effective mechanisms, use of special interview process, Forecast police sanctions And adopt police prevention mechanisms. Accordingly, due to the importance of the issue and it’s emerging in Iranian criminal justice system this study Deal with legislative developments in relation to the juvenile police in the international arena as well as in Iranian and America legal system.
