تاملی بر ضمانت اجراهای بین‌‌ المللی کیفری نسبت به اشخاص حقیقی

بررسی نسل‌های مختلف ضمانت اجراهای بین‌‌المللی کیفری نمایانگر فراز و فرودهایی است که روند تکاملی داشته و به تدریج به سمت ضمانت اجراهای اصلاحگرایانه و بازپرورانه حرکت نموده‌اند. این نوشتار به بررسی توصیفی تحلیلی تحول تدریجی ضمانت اجراهای بین‌‌المللی کیفری پرداخته است که در اساسنامه‌‌ها و آرای قضایی دیوان‌های بین‌‌المللی کیفری متبلور شده‌اند. ضمانت اجراهای نسل اول (اعدام، حبس ابد و حبس‌‌های زمان‌مند)، ضمانت اجراهای نسل دوم (حبس) و نسل سوم و چهارم ضمانت اجراهای بین‌‌المللی مشتمل بر ضمانت اجراهای کیفری و مدنی می‌شوند که در قالب انواع حبس‌‌ها، مصادره اموال و محکومیت‌‌های مالی قابل اعمال اند. امروزه اساسی ترین ضمانت اجرای بین‌‌المللی کیفری، حبس شامل (حبس ابد و حبس‌‌های زمان‌مند) است که در ماده 77 اساسنامه دیوان کیفری بین‌‌المللی به آن اشاره شده است. برخلاف تصور غالب، ضمانت اجراهای کیفری بین‌‌المللی از جدیت و قطعیت لازم برخوردار هستند. این بدین معناست که حتی اگر مراجع داخلی بنابر دلایلی عاجز از رسیدگی و محاکمه مجرمین بین‌‌المللی باشند، این امر باعث معافیت مجرم از مجازات نگردیده، بلکه دیوان کیفری بین‌‌المللی وارد عمل شده و اقدام به تعقیب پرونده می‌نماید.

the study of different generations of guarantees of international criminal performances shows the ups and downs that have evolved and have gradually moved towards guaranteeing reformist and rehabilitative performances.this article examines the gradual evolution of the guarantee of international criminal practices that are crystallized in the statutes and judicial rulings of the international criminal courts. guarantees of first generation executions (execution, life imprisonment and temporary imprisonment), guarantees of second generation executions (imprisonment) and third and fourth generation international enforcement guarantees include guarantees of criminal and civil executions in the form of various types of imprisonment, confiscation of property and financial penalties are enforceable.today, the most basic guarantee for the international implementation of criminal law is imprisonment (life imprisonment and temporary imprisonment), which is mentioned in article 77 of the statute of the international criminal court. contrary to popular belief, the guarantee of international criminal executions is serious and certain, which means that even if domestic authorities are unable to prosecute international criminals for various reasons, this does not absolve the offender from punishment, instead, the international criminal court intervened and prosecuted the case.
