امضای الکترونیک، زمینه‌ساز پیشگیری از جرایم ثبتی

امضای الکترونیک نتیجۀ محتوم ورود فناوری اطلاعات به عرصۀ مراودات حقوقی و ثبتی است. تازگی این موضوع و قرار گرفتن آن در بستر حقوقی جامعه از یک‌سو و کارکرد آن در پیشگیری از تقلبات تجاری و جرایم ثبتی از سوی دیگر اهمیت مطالعه و تحقیق را در این زمینه اقتضاء می‌کند. حوزه ثبت اسناد و املاک و به موازات آن، تجارت الکترونیکی عرصۀ تسجیل مالکیت، تنظیم و تنسیق اراده اشخاص و یکی از مهمترین سازکارهایی است که توسط دولت در جهت حفظ حقوق شهروندان در زمینه اموال، عقود و وقایع حقوقی اتخاذ می‌شود. شاید هدف ابتدائی ابداع امضای الکترونیک و فرایندهای مشابه آن، سرعت بخشیدن به مراودات تجاری و حقوقی بوده باشد؛ اما با توجه به فرایند و نحوه تحقق، می‌توان امضای الکترونیک را یکی از عوامل پیشگیری از وقوع جرم دانست. درک دقیق این فرایند مستلزم اشراف‌‌ نسبی بر دو مقوله است؛ یکی ماهیت و فرایند امضای الکترونیک و دیگر کیفیت و لازمه‌‌های پیشگیری. مقالۀ حاضر ضمن شناخت پیوند این دو واقعیت، درصدد بررسی لازمه‌‌ها و عوامل افزایش تاثیر امضای الکترونیک بر پیشگیری از جرم است.

abstractelectronic signature is one of the consequences of the development of technology and the expansion of the realm of legal transactions. electronic signature is the inevitable result of the entry of information technology into the field of legal and registration transactions. the novelty of this issue in the legal framework of the society and its important role in preventing commercial fraud and registered crimes shows the importance of study and research in this field. the domain of document and real estate registration and e-commerce are two realms of consolidating ownership and coordinating the will of individuals. these two issues are among the most important mechanisms used by the government to protect the rights of citizens. perhaps the primary purpose of electronic signature and similar processes was to speed up business transactions, but electronic signature can be considered as one of the factors of crime prevention now. accurate understanding of this process requires accurate knowledge of two issues: the nature and process of electronic signature and prevention quality and requirements.in this article, in addition to knowing the connection between these two facts, the author seeks to know the factors that increase the effect of electronic signature on crime prevention.
