اتحادیه اروپایی و دیوان بین المللی کیفری: همکاری و حمایت نهادین

تاسیس دیوان بین‌المللی کیفری بزرگ‌ترین دستاورد حرکت جامعه بین‌الملل به‌سوی استقرار عدالت کیفری تلقی می‌شود. بی‌تردید تحقق این ماموریت نمی‌تواند به‌تنهایی و بدون همکاری با سایر نهادهای بین‌المللی صورت پذیرد. مطالعه حاضر به بررسی همکاری دیوان با اتحادیه اروپا پرداخته است. بدین‌منظور، مبنای رابطه میان دو نهاد و تعهد اتحادیه به همکاری با دیوان و سپس اقدامات اتحادیه به‌منظور حمایت از این نهاد موردِبررسی قرار گرفت. اتحادیه اروپا از بدو تاسیس دیوان، سیاست حمایت از توسعه و ارتقای عملکرد دیوان را وجه همت خود قرار داده است. اتحادیه فرایندی را در چهارچوب اسناد مصوّب خود ایجاد کرده است تا دو محور حمایتی خود یعنی بسط صلاحیت سرزمینی و ارتقای عملکرد دیوان را سامان دهد. مهم‌ترین سند اتحادیه، سند موضع مشترک در رابطه با دیوان می‌باشد که توسط شورای اروپایی تصویب شد. سایر اسناد اتحادیه در‌این‌راستا، ازجمله برنامه اقدام و موافقتنامه معاضدت و همکاری، در پرتو این سند به تصویب رسید که مجموعاً چهارچوبی متّقن در همکاری و حمایت ارکان و اعضای اتحادیه از دیوان بین‌المللی کیفری ایجاد می‌کند.

The European Union and International Criminal Court: Institutional Cooperation and Support

Establishment of International Criminal Court (ICC) can undoubtedly be considered as the most significant achievement of the international community in its movement toward criminal justice. Such a mandate, however, cannot be achieved without support and cooperation with other international players. The present study will review the cooperation and support the ICC can receive from a regional arrangement such as the European Union. For this purpose, we will review issues such as the basis of obligations of the EU to support ICC, the major policies and the concrete actions adopted by the EU. The European Union as one important regional arrangement has defined its macropolicy toward ICC with a view to achieve two main goals, namely universality of the Rome Statute and effective functioning of the ICC. To realize those goals, EU has adopted certain measures including adoption of a common policy as basis of EUICC support; conclusion of a cooperation agreement as the basis for EUICC cooperation and several action plans to implement such documents. After a decade of support and cooperation, the EU policies and measures have provided a proper framework for such cooperation and support.
