درآمدی بر حقوق بیمۀ جنایی در راستای سیاست جناییِ بیمه‌مدار

امروزه دگردیسی در پاسخ دهی به جرم (استفاده از ظرفیت های غیر کیفری همانند: حقوق مدنی، اداری و انظباطی) به راهبری پاسخ شناسی جرم به جای مفهوم سنتی کیفر شناسی، به راهبردی اثرگذار در جهت مبارزه با جرم و بزه کاری تبدیل شده است. در این میان راهبرد عدالت توافقی بیمه مدار به عنوان تاسیسی بومی گرا و نوظهور در پرتو حق بر مجازات نشدن، نمونه ای بر ساخته در بستر عدالت متوازن جنایی است که ضمن پاسخ دهی غیر کیفری در برابر جرم، اسباب توجه به حقوق بزه دیدگان را با تمسک به ساز وکارهای بیمه ای (حقوق بیمه جنایی) فراهم آورده است. عدالت توافقی بیمه مدار گونه ای از عدالت توافقی است که ناظر به مرحله پیشا دادرسی و پسا دادرسی می باشد. این مدل عدالت در مواردی که حسن سلوک مرتکب نیاز به تضمینی فرا تر از تعهد اخلاقی وی دارد؛ با استفاده از تدبیر انتقال ریسک ، به توافقات ما بین مقام قضایی و بزه کار در قالب رژیم حقوقی بیمه ای، تضمینی کارآمد می بخشد. به گونه ای که ضمن کنترل و مدیریت ریسک ارتکاب بزه احتمالی از ناحیه مرتکب، نتیجه عدم حسن سلوک وی را (ارتکاب مجدد جرم) صرف جبران و ترمیم خسارت وارد به بزه دیدگان احتمالی می نماید. این مقاله به تبیین اثر گذاری این تاسیس در گستره پاسخ دهی به جرم با استفاده از ظرفیت های مشترک علوم جنایی و حقوق بیمه تحت قالب رشته ای نوین به نام حقوق بیمه جنایی می پردازد.

An Introduction to Criminal Insurance Law in the Light of an Insuranceoriented Criminal Policy

In the history of penal systems, the philosophy of punishment has been like a stream. While, in some era the retribution and revenge has been the prevail approach in criminal policy, in other times deterrence and rehabilitation overcome. In recent years, the criminal professors has emphasized to some punishments that without violence and pressures of prison and in a calm atmosphere rehabilitate the offenders. One of the industrial area that can be connect to philosophy of punishment is insurance industry. restorative insurance is an insurance that looks for rehabilitation and compensation in light of restorative justice principles. So, it can be said that restorative insurance is a purposeful connection between insurance industry, criminal law, criminal policy and victimology. These fields while are separate from each other and all of them have special goals, but they are common in relation with basic values like soul, property, honor and liberty. Otherwise, it seems that negligence to this connection causes to violate human dignity in different ways. Restorative insurance according to legal and industrial structures of insurance and regulation of it in light of cooperation principle is related to participative criminal policy to enhance the responsibility of society.
