پیامدهای سیاست کیفری عوام گرا در جرایم جنسی علیه اطفال و نوجوانان

امروزه بیش از گذشته شاهد قربانی جنسی شدن اطفال و نوجوانان هستیم. صرف‌نظر از روند روبه رشد این جرایم، می‌توان یکی از دلایل آن را پیشرفت و سهولت دسترسی به وسایل ارتباطجمعی دانست که بخش همیشه تاریک و پنهان این نوع بزه‌دیدگی را تا حدودی به حداقل رسانیده و از رقم سیاه آن کاسته است. هنگامی که جرایم بواسطه‌ی ادبیات ژورنالیستی و قلم‌های پرمخاطب و احساسی رسانه‌ها پردازش می‌شوند، علاوه بر ایجاد ترس و هراس در بطن جامعه، افکار تهییج شده‌ی عموم که دارای انتظارات و مطالباتی است را با خود همراه می‌کند. در این برهه‌ی زمانی خواست مردم، سرعت در رسیدگی و اجرای هر چه سریع‌تر و شدیدتر واکنش می‌باشد. بنابراین دستگاه عدالت کیفری برای اعاده‌ی نظم و آرامش جامعه و کسب مشروعیت و مقبولیت عمومی، شنوای صدای مردم شده و ناگزیر تمکین نموده و ترازوی عدالت را عوام‌گرایانه هویدا می‌کند. نتایج و پیامدهای اجتناب‌ناپذیر اتخاذ چنین تصمیمی، بر همگان روشن نبوده و نیازمند نگاه نقادانه و تخصصی بوده که در این پژوهش با استفاده از روش توصیفیتحلیلی به آن پرداخته و می‌توان از تبعات به‌ظاهر مثبت این رویکرد را، ایجاد آرامش هرچند موقتی احساسات و عواطف مردم و اطمینان از اجرای عدالت دانست و از تبعات منفی آن، فقدان دادرسی عادلانه و منصفانه‌ای که نگاه و واکنشی علمی و آسیب‌شناسانه در جهت چرایی افزایش این نوع جرایم و در نهایت کاهش وقوع آن باشد، را برشمرد.

In this study, using a descriptiveanalytical method, it is possible to create the apparently positive consequences of this approach, the creation of tranquility, as well as the temporary emotions of the people, and the assurance of the implementation of justice, and its negative consequences, the lack of a fair trial And fair, which would look at the scientific and pathologic response to the increase in this type of crime and eventually reduce its occurrence.
